Taylor and Valerie C. Taylor, husband and wife, Defendants, COMPLAINT IN MORTGAGE FORECLOSURE AND NOW, this day of Mqy , 2008, comes Plaintiff, Adams County National Bank, by its attorneys, Puhl, Eastman & Thrasher, who brings this action in mortgage foreclosure against Jeffrey C. Taylor and Valerie C. Taylor, Defendants, whereof the following is a statement: 1. Plaintiff, Adams County National Bank, is a national banking corporation organized and existing under the laws of Congress relating to national banks, with its main office at 16 Lincoln Square, Borough of Gettysburg, Adams County, Pennsylvania 17325. 2. Defendant, Jeffrey C. Taylor, is an adult individual whose last known address is 110 Pennsylvania Avenue, Camp Hill, Cumberland County, Pennsylvania 17011. 3. Defendant, Valerie C. Taylor, is an adult individual whose last known address is 334 East Meadow Drive, Mechanicsburg, Cumberland County, Pennsylvania 17055. 4. On March 14, 2003, Defendants made, executed, and delivered a mortgage upon real estate hereinafter described to Plaintiff as Mortgagee, which mortgage is recorded in the Office of the Recorder of Deeds of Adams County, Pennsylvania in Record Book 1801 at page 3460. A copy of said mortgage is attached hereto and marked as Exhibit "A." Said mortgage is incorporated herein by reference. 5. The mortgage secures a note executed by Defendants' corporation dated March 14, 2003, in the amount of $123,750.00, payable to Plaintiff in monthly installments with interest adjusted as per terms of the note, a copy of which is attached hereto as Exhibit "B" and incorporated herein by reference. 6. There has been no assignment of said mortgage. 7. The real estate subject to the mortgage is described as follows: ALL THAT CERTAIN tract of land situate in Upper Allen Township, County of Cumberland and Commonwealth of Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNING at an iron pin at the point of intersection of the westerly right-of-way line of Reynolds Street (50' wide) and the southerly right-of-way line of Cumberland Parkway (relocated) (60' wide); thence along said right-of-way line of Reynolds Street, South 09 degrees 29 minutes 38 seconds East, a distance of 166.65 feet to an iron pin at line of lands now or formerly of George Von Nieda; thence along said lands now or formerly of George Von Nieda, South 84 degrees 42 minutes 22 seconds West, a distance of 110.35 feet to a point; thence continuing along same, South 83 degrees 32 minutes 19 seconds West, a distance of 141.44 feet to a point; thence South 83 degrees 28 minutes 42 seconds West, a distance of 219.30 feet to a point of intersection with the southern line of a 60' wide right-of-way for Relocated Cumberland Parkway and Lot No. 3; then along same by a curve to the left having a radius of 430.00 feet, an arc length of 253.72 feet to a point; thence continuing along the southern right-of-way line of Cumberland Parkway (relocated), North 49 degrees 40 minutes 14 seconds East, a distance of 22.21 feet to a point; thence continuing along same by a curve to the right having a radius of 470.00 feet, an arc distance of 252.94 feet to an iron pin, the place of BEGINNING. BEING Lot 3 on Preliminary/Final Subdivision Plan for AMP Incorporated, dated November 16, 1993, recorded March 10, 1995 in Cumberland County Plan Book 69, Page 115. CONTAINING 0.924 acres, more or less. UNDER AND SUBJECT to Declaration of Protective Covenants for AMP Incorporated Property dated September 22, 1993, recorded October 28, 1993 in the Cumberland County Recorder of Deeds Office and all other rights, reservations, restrictions and encumbrances of record. 8. The present owners of the real estate subject to the mortgage are Defendants. 9. Said mortgage matured on March 14, 2008, when the whole of the said mortgage debt and interest became immediately due and payable. 10. The following amounts are due in accordance with the terms of the mortgage: I (a) Balance of unpaid principal $39,881.38 (b) Interest from 05/22/08 to 0528/08 $ 76.48 (Plus $10.93 per diem thereafter) (c) Late charges to 05/28/08 $ 5,048.38 (d) Other fees $ 348.30 (e) Attorney's commissions 3,401.59 TOTAL $48,756.13 11. The attorney's commissions set forth above are in conformity with the mortgage documents and Pennsylvania law and will be collected in the event of a third party purchaser at Sheriff's Sale. I' 12. The aforesaid mortgage is not a residential mortgage and does not come within the provisions of Act 91 of 1983 and Act 6 of 1974, as amended. WHEREFORE, Plaintiff demands IN REM judgment in mortgage foreclosure for the sum of $48,756.13, plus interest from May 29, 2008, at a per diem of $10.93, additional late charges, costs of suit, and other charges collectible under the terms of the mortgage; for the j foreclosure and sale of the mortgaged property; and for other relief as the Court deems appropriate.
