surviving spouse is three (3) percent [72 P.S. ~9116 (a) (1.1) (i)].
For dates of death on or after January 1, 1995, the tax rate imposed on the net value of transfers to or for the use of the surviving spouse is zero
(0) percent [72 P.S. 99116 (a) (1.1) (ii)]. The statute does not exempt a transfer to a surviving spouse from tax, and the statutory requirements
for disclosure of assets and filing a tax return are still applicable even if the surviving spouse is the only beneficiary.

The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a
natural parent, an adoptive parent, or a stepparent of the child is zero (0) percent [72 P .5. 99116 (a) (1.2)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is four and one-half (4.5) percent,
except as noted in 72 P.S. 99116 1.2) [72 P.S. 99116 (a) (1)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's siblings is twelve (12) percent [72 P.S. ~9116 (a) (1.3)}. A
sibling is defined under Section 9102, as an individual who has at least one parent in common with the decedent, whether by blood or adoption.

LAST WILL AND TESTAMENT
I, Ezra E. Karper, Jr., presently residing at 49 Big Pond Road, Shippensburg,
Southampton Township, Cumberland County, Pennsylvania 17257, being of sound mind, memory
and disposition, do hereby make, publish and declare this my Last Will and Testament, hereby
revoking and making void all Wills by me at any time heretofore made.
FIRST. I order and direct the payment of all my legally enforceable debts and
funeral expenses as soon as may be convenient after my decease.
SECOND. I give, devise and bequeath all my estate, real, personal and mixed,
whatsoever and wheresoever situate to my sons, namely, Richard E. Karper, James E. Karper,
and Paul E. Karper, in equal shares, on a per stirpes distribution basis, it being my specific intent
to exclude my wife, Bertha L. Karper and my daughters, namely, Julia L. Kuhn, Shirley F.
Karper and Dorinda K. Smith, from any distribution under this my Last Will and Testament.
THIRD. I nominate, constitute and appoint my sons, Richard E. Karper, James E.
Karper and Paul E. Karper, or the survivor(s) thereof, to be the Co-Executors of this my Last
Will and Testament.
FOURTH. I direct that my personal representative(s) shall not be required to give bond
for the faithful performance of their duties in any jurisdiction.
FIFTH. I hereby direct that all federal, state and other death taxes payable because
of my death, with respect to the property forming my gross estate for tax purposes, whether or not
passing under this Will, including any interest or penalty imposed in connection with such taxes,
shall be considered a part of the expense of administration of my estate and that such be paid out
of the rest and residue of my estate.
SIXTH. I direct my Executor to retain the services of Jerry A. Weigle, Esquire,
with offices located at 126 East King Street, Shippensburg, Pennsylvania 17257, with respect to
the settlement of my estate due to his famiiiarity wiih my affairs.

MORTGAGE
THIS MORTGAGE is made the ~ day of ~~\.... L.. 2006, between the
Mortgagors, WALTER S. BURKHOLDER and MARY R. ~, (herein, whether
more than one, "Borrower") and the Mortgagee, EZRA E. KARPER, (herein "Lender").
WHEREAS, Borrower is indebted to Lender in the principal sum of One Hundred Twenty-
Five Thousand ($125,000.00) Dollars, which indebtedness is evidenced by Borrower's Note dated
September 2 ~ 2006 (herein "Note") providing for payments of principal and interest as is
specified therein, with the balance of the indebtedness, ifnot sooner, due and payable on September
~2016;and
WHEREAS, to secure to Lender (a) the repayment of the indebtedness evidenced by the
Note, with interest thereon, the payment of all other swns, with interest thereon, advanced in
accordance herewith to protect the security of this Mortgage, and the performance of the covenants
and agreements of Borrower herein contained, and (b) the repayment of any futlU'e advances, with
interest thereon, made to Borrower by Lender pursuant hereto (herein "Future Advances"),
Borrower does hereby mortgage, grant and convey to Lender the following described property
located in the County of Cumberland, State of Pennsylvania:
See legal description set forth on Schedule A attached hereto and incoxporated herein by reference;
which has the address of 49 Big Pond Road, Shippensburg, Pennsylvania 17257 (herein "Property
Address");
TOGETHER with all the improvements now or hereafter erected on the property, and all
easements, rights, appurtenances, rents, royalties, mineral, oil and gas rights and profits, water,
water rights, and water stock, and all fixtures now or hereafter attached to the property, all of which,
including replacements and additions thereto, shall be deemed to be and remain a part of the
property covered by this Mortgage; and all of the foregoing, together with the property are herein
referred to as the "Property".
Borrower covenants that Borrower is lawfully seized of the estate hereby conveyed and has
the right to mortgage, grant and convey the Property, and that Borrower will warrant and defend
generally the title to the Property against all claims and demands, subject to any declarations,
easements or restrictions listed in a schedule of exceptions to coverage in any title insurance policy
insuring Lender's interest in the Property, or any certificate of title certifying Lender's interest in the
Property.
TO HA VE AND TO HOLD the same unto and for the use of Lender, its successors and
assigns, forever.

PROVIDED, however, that if the Borrower shall pay and perform, according to the
conditions hereof and the Note, everything to be paid and performed as aforesaid, then the estate
hereby conveyed and granted shall become null and void.
BORROWER AND LENDER covenant and agree as follows:
ADDITIONAL FUTIJRE ADVANCES. The Mortgage and the lien thereof shall be
security not only for the original indebtedness evidenced by the accompanying Note, but also for
any other sums that may be loaned or advanced by Lender to the Borrower at any time or times
hereafter, made, with respect to the PrOperty, for the payment of taxes, assessments, maintenance
changes, insurance premiums or costs inCUrred for the protection of the Property or the lien of the
mortgage, expenses incurred by the Lender by reason of default by the Borrower hereunder (or
under the Note) or advances made to enable completion of the improvements for which the loan
was originally made (as is provided for in 42 PA C.S.A. 8144, Act of October 12, 1990, P.L. 525,
No. -126).
PAYMENT OF TAXES, INSURANCE PREMIUMS AND OTHER CHARGES. From
time to time, until the debt and interest are fully paid, Borrower shall pay and discharge, when and
as the same shall become due and payable, all taxes, assessments, sewer and water rents, and all
other charges and claims assessed or levied by any lawful authority upon any part of the Property;
pay all ground rents reserved from the Property and pay and discharge all mechanics' liens which
may be filed against the Property and which shall or might have priority in lien or payment to the
debt secured hereby; provide, renew and keep alive such policies of hazard and liability insurance
as Lender may from time to time require upon the buildings and improvements now or hereafter
erected upon the Property, with loss payable clauses in favor of Lender as its interest may appear.
The insurance carrier providing the insurance shall be chosen by Borrower subject to
approval by Lender; provided, that such approval shall not be unreasonably withheld. All
premiums on insurance policies shall be paid by Borrower making payment, when due, directly to
the insurance camer.
All insurance policies and renewals thereof shall be ~ form acceptable to Lender and shall
include a standard mortgage clause in favor of and in form acceptable to Lender. Lender shall have
the right to hold the policies and renewals thereof: and Borrower shall promptly furnish to Lender
aU renewal notices and all receipts of paid premiums. In the event of loss, Borrower shall give
prompt notice to the insurance carrier and Lender. Lender may make proof of loss if not made
promptly by Borrower.
Unless Lender and Borrower otherwise agree in writing, insurance proceeds shall be applied
to restoration or repair of the Property damaged, provided such restoration or repair is economically
feasible and the security of this Mortgage is not thereby impaired. If such restoration or repair is
not economically feasible or if the security of this Mortgage would be impaired, the insurance

proceeds shall be applied to the sums secured by this Mortgage, with the excess, if any, paid to
Borrower. If the Property is abandoned by Borrower, or if Borrower fails to respond to Lender
within 30 days from the date notice is mailed by Lender to Borrower that the insurance camer
offers to settle a claim for insurance benefits, Lender is authorized to collect and apply the
insurance proceeds at Lender's option either to restoration or repair of the Property or to the sums
secured by this Mortgage.
Unless Lender and Borrower otherwise agree in writing, any such application of proceeds to
principal shall not extend or postpone the due date of the monthly installments hereof or change the
amount of such installments. If the Property is acquired by Lender, all right, title and interest of
Borrower in and to any insurance pOlicies and in and to the proceeds thereof resulting from damage
to the Property prior to the sale or acquisition shall pass to Lender to the extent of the smns secured
by this Mortgage immediately prior to such sale or acquisition.
MAINTENANCE OF MORTGAGED PROPERTY. Borrower shall maintain all buildings
and improvements subject to this Mortgage in good and substantial repair as detennined by Lender.
Lender shall have the right to enter upon the Property at any reasonable hour for the purpose of
inspecting the order, condition and repair of the building or buildings erected thereon.
NONPAYMENT OF TAXES, INSURANCE, OlliER CHARGES, AND COST OF
REPAIRS. In the event Borrower neglects or refuses to pay the taxes, insurance premiums or other
charges above mentioned, within 30 days after the same become due and payable, or fails to
maintain the buildings and improvements as aforesaid, then the Lender may, at is option but
without any obligation to do so, advance the sums required and add any amounts so advanced to the
principal debt secured hereby, and collect the same as a part of the principal debt.
Any amounts disbursed by Lender pursuant hereto, with interest thereon, shall become
additional indebtedness of Borrower secured by this Mortgage. Unless Borrower and Lender agree
to other terms of payment, such amounts shall be payable upon notice from Lender to Borrower
requesting payment thereof, and shall bear interest from the date of disbursement at the rate payable
from time to time on outstanding principal under the Note unless payment of interest at such rate
would be contrary to applicable law, in which event such amoWlts shall bear interest at the highest
rate permissible under applicable law. Nothing contained herein shall require Lender to incur any
expense or take any action hereunder.
TRANSFER OR ENCUMBRANCE OF MORTGAGED PROPERTY. Borrower agrees
not to transfer legal or equitable title to the Property unless the Lender consents in writing to such
transfer. PROHmmON AGAINST TRANSFER OF TITLE TO MORTGAGED PROPERTY
CONTAINED HEREIN SHALL BE APPLICABLE TO THE TRANSFER OF EQUITABLE AS
WELL AS LEGAL TITLE WHETHER BY DEED, ARTICLES OF AGREEMENT, CONTRACT
FOR DEED, OPTION OR OTHERWISE EXCEPT FOR SUCH AGREEMENTS OF SALE FOR
PURPOSES OF CONVEYING LEGAL TITLE WITHIN 180 DAYS OF EXECUTION OF
SUCH AGREEMENT OF SALE. UPON ANY TRANSFER IN VIOLATION OF THIS

PROVISION, LENDER SHALL HAVE THE OPTION OF ACCELERA TINO THE MATURITY
OF THE ENTIRE UNPAID BALANCE OF INDEBTEDNESS.
CONDEMNATION. The proceeds of any award or claim for damages, direct or
consequential, in connection with any condemnation or other taking of the Property, or part thereof,
or for conveyance in lieu of condemnation, are hereby assigned and shall be paid to Lender.
In the event of a total taking of the Property, the proceeds shall be applied to the swns
secured by this Mortgage, with the excess, if any, paid to Borrower. In the event of a partial taking
of the Property, unless Borrower and Lender otherwise agree in writing, there shall be applied to
the swns secured by this Mortgage such proportion of the proceeds as is equal to that proportion
which the amount of the sums seCured by this Mortgage immediately prior to the date of taking
bears to the fair market value of the Property immediately prior to the date of taking, with the
balance of the proceeds paid to Borrower.
If the Property is abandoned by Borrower, or if, after notice by Lender to Borrower that the
condemnor offers to make an award or settle a claim for damages, Borrower fails to respond to
Lender within 30 days after the date such notice is mailed, Lender is authorized to collect and apply
the proceeds, at Lender's option, either to restoration or repair of the Property or to the swns
secured by this Mortgage.
Unless Lender and Borrower otherwise agree in writing, any such application of proceeds to
principal shall not extend or postpone the due date of the monthly installments hereof or change the
amount of such installments.
REMOVAL OR ALTERATION OF IMPROVEMENTS. Borrower agrees not to remove,
demolish or make any substantial alterations to any improvements now or hereafter on the
mortgaged Property unless Lender consents in writing thereto.
BORROWER NOT RELEASED. Extension of the time for payment or modification of
amortization of the sums secured by this Mortgage granted by Lender to any successor in interest of
Borrower shall not operate to release, in any manner, the liability of the original Borrower and
Borrower's successors in interest. Lender shall not be required to commence proceedings against
such successor or refuse to extend time for payment or otherwise modify amortization of the sums
secured by this Mortgage by reason of any demand made by the original Borrower and Borrower's
successors in interest.
FORBEARANCE BY LENDER NOT A WAIVER. Any forbearance by Lender in
exercising any right or remedy hereunder, or otherwise afforded by applicable law, shall not be a
waiver of or preclude the exercise of any such right or remedy. The procurement of insurance or
the payment of taxes or other liens or charges by Lender shall not be a waiver of Lender's right to
accelerate the maturity of the indebtedness secured by this Mortgage.

REMEDIES CUMULATNE. All remedies provided in this Mortgage are distinct and
cumulative to any other right or remedy under this Mortgage or afforded by law or equity, and may
be exercised concurrently, independently or successively.
NOTICE. Except for any notice required under applicable law to be given in another
manner, (a) any notice to Borrower provided for in this Mortgage shall be given by mailing such
notice by certified mail addressed to Borrower at the Property Address or at such other address as
Borrower may designate by notice to Lender as provided herein., and (b) any notice to Lender shall
be given by certified mail, return receipt requested, to Lender's address stated herein or to such
other address as Lender may designate by notice to Borrower as provided herein. Any notice
provided for in this Mortgage shall be deemed to have been given to Borrower or Lender when
given in the manner designated herein.
PURCHASE MONEY MORTGAGE. If all or part of the sums secured by this Mortgage
are lent to Borrower to acquire title to the Property, this Mortgage is hereby declared to be a
purchase money mortgage.
GOVERNING LAW. This mortgage shall be governed by the law of Pennsylvania. The
tenns of this Mortgage and the Note are hereby declared to be severable and the invalidity of any
such provision shall not invalidate the remB;n;ng provisions.
ASSIGNMENT OF RENTS AND LEASES. Borrower assigns and transfers unto Lender
any and all rents from the mortgaged Property and all leases of the mortgaged Property or portions
thereof now or hereafter entered into, and authorizes the Lender, at any time there is a default under
the Mortgage or accompanying Note, to take possession of, rent, repair and operate the Property
and, after deducting all costs of collection, operation, repairs and administration, to apply the
balance of the rents received on account of the obligation of the Borrower, Lender shall have full
power to lease or renew leases upon such tenns and conditions as to Lender may seem proper or
desirable.
ACCELERATION OF MATURITY AND FORECLOSURE PROCEEDINGS UPON
DEFAULT. In case default be made by the Borrower in the payment of any installment of
principal, interest or other smns payable under the terms of this Mortgage or the accompanying
Note, or in the event of a breach by the Borrower of any of the other obligations, covenants,
conditions and agreements set forth in this Mortgage or in the accompanying Note, which default or
breach shall continue for more than thirty (30) days, then and in such case the entire unpaid balance
of the indebtedness, including advances and all other swns paid by the Lender in accordance with
the terms of this Mortgage or the accompanying Note, together with unpaid interest thereon, shall,
at the option of the Lender, and without notice, (except as may be required by then applicable law),
become immediately due and payable, and foreclosure proceedings may be brought forthwith on
the Mortgage or legal action may be commenced on the accompanying Note and prosecuted to
judgment, execution and sale for the collection of the same, together with costs of suit and an
attorney's commission for collection of ten per centum of the total indebtedness or two hundred
