EST ATE SETTLEMENT AGREEMENT
This agreement made as of this 5th day of February 2007 by and between Sharon E. Tocket
individually and as executrix of the Estate of Edith B. Miller, deceased late of Cumberland County,
Pennsylvania, party ofthe fIrst part is hereinafter called Sharon and James E. Miller Jr., her brother, party
of the second part hereinafter called James, WITNESSETH:
The parties hereto intending to be legally bound hereby declare, promise and agree as follows:
1. Edith B. Miller, mother of the parties hereto died on June 9, 2006, testate.
2. Decedent's last will and testament was probated by the Register of Wills of Cumberland County,
Pennsylvania on July 11,2006 and letters testamentary were granted to Sharon E. Tocket party of
the fIrst part herein.
3. The Estate was advertised in the Cumberland Law Journal and The Sentinel newspapers.
4. Notice of Beneficial Interest was sent by Attorney Robert E. Myers to and received by the parties
hereto.
5. Decedent's Will devised and bequeathed her assets to the parties hereto.
6. A State Inheritance Tax Return has been fIled with the Register of Wills and Inheritance Tax paid
In the amount of$8, 1 69.32.
7. Parties hereto believe all of decedent's debts have been paid and therefore have elected to close
out the assets of decedents estate by this family agreement.

10. Parties hereto have equally individually voluntarily contributed $1,792.18 to executrix so
executrix could pay all known debts and is the foregoing deficit of$3,584.36.
il. In the event any additional debts are claimed, parties hereto would agree to pay share claimant
entitled to of said net assets. When claims exceed assets of estate then claimants are entitled to
share net assets on a pro-rate basis.
12. James does hereby quit claim and forever release Sharon of and from any and all claims
whatsoever as to Sharon being executrix of the estate of Edith B. Miller.
