Petitioner, Mallory Sherman, by and through her attorneys the Family Law Clinic, hereby
requests that the Court dismiss the Petition to Vacate Guardianship filed on June 2, 2008 in the
above-captioned matter. In support of her Motion, Petitioner avers the following:
1. Petitioner filed a Petition to Vacate Guardianship with the Court on June 2,
2008. An Order of Court was issued by the Honorable Edward E. Guido on June 4,
2008, scheduling the matter to be heard on June 5, 2008 at 3:15 p.m.
2. Petitioner has returned to reside at the home of Kingsley and Theresa Sherman, and
no longer wishes to pursue the Petition to Vacate Guardianship, as she now has
access to her minor child, Jake Nicholas Sherman.
3. The parties shall proceed in the custody action through the conciliation process.
A custody conciliation has been scheduled for June 16, 2008.
4. Pursuant to GC.R.P 208.2(d), concurrence of counsel, G. Patrick O'Connor was
sought. No response was received as of the time of filing this Motion.
WHEREFORE, Petitioner requests that the Court vacate the Order of Court of June 4, 2008
thereby canceling the hearing scheduled for June 5, 2008 at 3:15 p.m.
