Bayley, Esquire, and presents the following complaint for custody, representing as follows: 1. The Plaintiff, Kevin Bretz, is an adult individual residing at 12 Glenn View Circle, Dillsburg, PA, 17019. 2. The Defendant, Mary Bretz, is an adult individual residing at 816 Highland Court, Mechanicsburg, PA, 17055. 3. The Defendant, Sandra Benner, is an adult individual residing at 816 Highland Court, Mechanicsburg, PA, 17055. 4. The Defendant, John Benner, is an adult individual residing at 61 Southpoint, Mechanicsburg, PA 17055. 5. Plaintiff seeks custody of the following children: Name Present Residence Age D/OB Cameron Bretz 816 Highland Court, Mechanicsburg 16 4/9/92 Gabrielle Bretz 816 Highland Court, Mechanicsburg 12 12/26/97 6. The children were not born out of wedlock. 7. The relationship of the Plaintiff to the children is that of natural father. The Plaintiff currently resides with Angie Sundell (Father's fiance), Mellissa Sundell (step-sister), Olivia Sundell (step-sister) and Cole Bretz (half-brother). He is not married. 8. The relationship of the Defendant, Mary Bretz, to the children is that of natural mother. Mary Bretz currently resides with the children, Sandra Benner (maternal grandmother) and Isiah Bretz (half-brother). She is not married. 9. The relationship of the Defendant, Sandra Benner, to the children is that of maternal grandmother. Sandra Benner currently resides with the children, Mary Bretz (mother) and Isiah Bretz (half-brother). She is not married. 10. The relationship of the Defendant, John Benner, to the children is that of maternal grandfather. It is unknown to Plaintiff whether or not anyone resides with John Benner. He is not married. 11. The Plaintiff has not participated as a party or witness, or in another capacity in other litigation concerning the custody of the children is this or any other Court. 13. Sandra Benner previously filed a custody complaint as Plaintiff with Mary Bretz listed as Defendant under Cumberland County docket number 2004-5097. This action has since produced two Orders of Court attached hereto as "Exhibit A" and Exhibit B." 14. Other than as provided by the attached orders, Plaintiff does not know of a person nor a party to the proceeding who has physical custody of the children or claims to have custody or visitation rights with respect to the children. 15. The best interests and permanent welfare of the children require Plaintiff to have specified periods of physical custody which may be agreed upon at conciliation or otherwise be determined by the Court to be in the best interests of the children.
