Bogar, Esquire, and files the following municipal claim against STEPHEN C. LOGAN and PATRICIA LOGAN, husband and wife, adult individuals, owning property located at 1316 Zimmerman Road, Carlisle, Monroe Township, Cumberland County, Pennsylvania, 17013, their last known mailing address being: 1316 Zimmerman Road, Carlisle, Monroe Township, Cumberland County, Pennsylvania 17013. STEPHEN C. LOGAN and PATRICIA LOGAN are the owners of all that certain lot of ground, including any improvements thereon, being more fully described as follows: ALL THAT CERTAIN tract of land with the improvements thereon erected, situate in Monroe Township, Cumberland County, Pennsylvania, bounded and described as follows: BEGINNING at a point on the Eastern side of Township Road No. 553 (also known as Zimmerman Road), on the dividing line between Lots Nos. 3 and 4 on the hereinafter mentioned Plan of Lots; thence by said dividing line, North fifty-five (55) degrees six (6) minutes thirty-five (35) seconds East 194.77 feet to a point; thence by the dividing line between Lots No. 4 and 6 on said Plan of Lots, South twenty-four (24) degrees East 12.4 feet to a point; thence by the same, South fifty-six (56) degrees sixteen (16) minutes East 61.32 feet to a point; thence by the dividing line between Lots Nos. 4 and 5 on said Plan of Lots, South thirty-three (33) degrees forty-four (44) minutes West 183.496 feet to a point on the Eastern side of Township Road No. 553 aforesaid; thence by the Eastern side of said Road, North fifty-six (56) degrees sixteen (16) minutes west 81.08 feet to a point; thence by the same on a curve to the right having a radius of 222.04 feet, an arc distance of 62.52 feet to the Place of BEGINNING. BEING Lot No. 4 on the Plan of Lots of Genevieve A. Diehl, as recorded in the office of the Recorder of Deeds for Cumberland County in Plan Book 25, Page 132; and being improved with a brick ranch type dwelling house. BEING THE SAME PREMISES which Stephen C. Logan and Patricia Logan, formerly known as Patricia Koser, his wife, by deed dated March 12, 2001, and recorded March 22, 2001 in the office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book 241, Page 299, granted and conveyed unto Stephen C. Logan and Patricia Logan, husband and wife, owners. Tax Parcel No. 22-70-0640-064. Monroe Township Municipality Authority hereby files this Municipal Lien for Services and Sewer Rates levied and assessed from January 1, 2007 through and up to and including May 23, 2008 (first calendar quarter 2007 through and including first calendar quarter 2008 and up to and including May 23, 2008). Said Authority services and sewer rates were levied and assessed -2- pursuant to Authority Resolution No. 02-04, same being known as a Resolution of the Board of Monroe Township Municipal Authority imposing user charges to be collected from the owner of each improved property served or to be served by this Authority's sewer systems; and providing for payment and collection of such user charges. Attached hereto and incorporated herein are the statements forwarded by Monroe Township Municipal Authority to Stephen C. Logan and Patricia Logan for sewerage due to be treated from January 1, 2007 through and up to and including May 23, 2008 (first calendar quarter 2007 through and including first calendar quarter 2008 and up to and including May 23, 2008), which services total is in the amount of $1,464.69, which sum was duly assessed against Stephen C. Logan and Patricia Logan, and the real property described herein from the date of said billing statements as attached hereto, and for which sum, with interest in the amount of ten (10%) percent, along with penalties and all costs, including attorneys' fees, a municipal lien is claimed against the above-described real property and premises in accordance with -3- the Act of May 16, 1923, P.L. 207, §7, as amended, 53 P.S. §7101, et seq, as amended (Municipal Claims and Tax Liens). As of the last billing notice, samc being dated 2-15-08, the delinquency is in the amount of $1,464.69. The purpose of this letter is to request that these accounts be brought current. If the accounts are not brought current within ten (10) days of receipt of this letter, a Municipal Tien v„!' be placed against real estate owned by you., same being known and numbered as 1316 Zimmermn Road, Cartsle, PA. This will result in filing fees, service costs and attorney's fees. Attorney's fees that are incurred with respect to the collection of this delinquent account will be assessed. Attorney's fees will be charged at the current rate. Attorney's fees will be imposed and/or assessed if this amount remains delinquent after thirty (30) days from the mailing of this notice (if by certified mail) or within text (10) days after mailing of this notice (if by regular mail). The imposition of assessment of attorney's fees may be avoided by you making payment in full of the delinquency within ten (10) days of receipt of this letter as set forth herein.
