Piper, Petitioners, and respectfully states as follows: ;~° o ~"
1. For the reasons set forth in the below numbered paragraphs, no counsel
has been retained on behalf of Richard L. Piper, the alleged incapacitated person, and it is
suggested that it would be inappropriate and unnecessary for counsel to be appointed to
represent the said Richard L. Piper.
2. The alleged incapacitated person was present with the Petitioners and the
undersigned at the initial conference concerning the Petition to have him declared
incapacitated. Although he did not communicate, and appeared physically unable to
communicate, he did not appear to be distressed or upset by the matters discussed.
3. His physician, Philip A. Neiderer, D.O. testified at his deposition that the
alleged incapacitated person would be incapable of communicating with counsel and the
representation would be ineffective. The certified copies of the deposition will be filed in
the above captioned matter.

4. His physician further testified that the Petitioners have always acted in the
alleged incapacitated person's best interests and have been faithfully involved in his care.
The alleged incapacitated person will be present at the scheduled Hearing
at which time the Court may appoint counsel for him if determined to be appropriate.
