STIPULATION AGAINST LIENS
WltEREAS, Barbara A. Richardson, of Cumberland, Pennsylvania, is about to
execute contemporaneously herewith, a contract with Countryside Village Homes, Inc. of West
Virginia, for the erection of a dwelling upon a lot of land situate as follows:
ALL THAT CERTAIN tract of land situate in North Newton Township,
Cumberland County, Pennsylvania, bounded and described in accordance with a Plan prepared by
Rodney Lee Decker, R.P.L.S., dated June 8, 1989 and recorded in the Office of the Recorder of
Deeds for Cttmberland County in Plan Book 58, Page 109.
BEGINNING at a point in western right of way line ofT-328, Running Pump Road
at comer of Lot No. 4 on said Plan; thence along Lot No. 4 North 66 degrees 35 minutes 00 seconds
West 300.00 feet to a point at Lot No. 2; thence along Lot No. 2 North 23 degrees 25 minutes 00
seconds East, 150.00 feet to a point; thence along Lot No. 2 South 66 degrees 35 minutes 00 seconds
East, 300.00 feet to a point; thence along western right-of-way ofT-328, Rtmrfing Pump Road, South
23 degrees 25 minutes 00 seconds West, 150.00 feet to a point the Place of BEGINNING.
CONTAINING 1.033 acres and designated as Lot No. 3 of North Newton Manor.
UNDER AND SUBJECT, NEVERTHELESS to the following building and use
restrictions which shall be binding on the within described tract of land only and shall not be deemed
binding on other land of the Grantors, with which building and use restrictions and within Grantees,
their heirs and assigns, by acceptance of this deed agree to comply.
No mobile homes are permitted on any lot in this subdivision.
All residential structures shall have a minimum of 1200 square feet of finished living
floor area.
No licensed vehicles, junk yard or junk cars are permitted on any lot at any time.
There shall be no stockpiling of any material except firewood on any lot at any time.
No commercial farming.
No open dumping.
BEING THE SAME premises which Kimba, Inc., a Pennsylvania Corporation; John
H. Fox, a single person; Cinda L. Fox, a single person; Harry H. Fox, Jr., a single person; Anne G.
Fox, a single person and Harmon Graves Company, a Pennsylvania Corporation by their deed dated
December 21, 2003 and recorded December 29, 2003 in the Office of the Recorder of Deeds in and
for Cumberland County, Pennsylvania in Deed Book 260, Page 4976, granted and conveyed unto
Barbara A. Richardson, a married woman.
NOW, the ~k~ -day of February, 2004, at the time of and immediately before
the execution of the principal contract, and before any authority has been given by the said Barbara
A. Richardson, to the said Countryside VillageHomes, Inc. to commence work on the said
building, or purchase materials for the same in consideration of the making of the said contract with
Countryside Village Homes, Inc. and the further consideration of One Dollar, to Countryside Village
Homes, Inc, paid by Barbara A. Richardson, it is agreed that no lien shall be filed against the
building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any
other person for any labor, or materials purchased, or extra labor or materials purchased for the
erection of said building, the fight to file such liens being expressly waived.
