Plaintiffs Matthew Harshbarger and Tara Harshbarger ("Plaintiffs") are adult individuals residing at 1602 Town Hill Road, York Springs, Adams County, Pennsylvania 17372. 2. Defendants Yolanda Gauthier-Hamel and Mark Hamel ("Defendants") are adult individuals residing at 650 2"d Street, Highspire, Dauphin County, Pennsylvania 17034. 3. On or about January 22, 2008, Plaintiff Matthew Harshbarger was operating a 2004 Chevrolet Silverado K-1500 j ointly owned by Plaintiffs Matthew Harshbarger and Tara Harshbarger on South 32"d Street, Camp Hill, Cumberland County. 4. On or about January 22, 2008, Defendant Yolanda Gauthier-Hamel was operating a 2003 Hyundai Santa Fe owned by Defendant Mark Hamel on South 32"d Street, Camp Hill, Cumberland County. 5. Plaintiff Matthew Harshbarger was driving in the right turn lane of South 32"d Street. 6. Defendant Yolanda Gauthier-Hamel was driving in the right straight through lane of South 32nd Street. 7. Defendant Yolanda Gauthier-Hamel attempted to change lanes to the right turn lane when she struck the vehicle Plaintiff Matthew Harshbarger was operating. 8. As a direct and proximate result of the collision, Plaintiffs incurred damages in the amount of $3,347.06. A copy of the estimate to repair Plaintiffs' vehicle is attached as Exhibit "A," and a copy of the collision supplement is attached as Exhibit "B." Plaintiffs' damages include rental charges as set forth in the rental invoices attached as Exhibit "C." COUNT I - Negligence Matthew Harshbarger and Tara Harshbarger. h/w v Yolanda Gauthier-Hamel 9. Paragraphs 1 through 8 are incorporated herein as if fully set forth below. 10. The collision occurred solely as a result of the negligence, recklessness, and carelessness of the Defendant Yolanda Gauthier-Hamel in that she: a. failed to properly change lanes; b. operated a vehicle in a careless, reckless, and negligent manner; C. failed to properly operate and control her vehicle; d. failed to operate the vehicle under the proper control so as to prevent striking Plaintiffs' vehicle; e. failed to keep a proper look out; f. failed to use due care under the circumstances; and g. operated the vehicle in disregard of the rules of the road, the ordinances of the local municipality and the laws of the Commonwealth of Pennsylvania. 11. Defendant Yolanda Gauthier-Hamel was the direct and proximate cause of the damage to Plaintiffs' Chevrolet. 12. At all times material hereto, Plaintiffs acted with due care and were not contributorily negligent. 13. Plaintiffs have demanded compensation for the losses they sustained and Defendant Yolanda Gauthier-Hamel has failed to pay. 14. Defendant Yolanda Gauthier-Hamel otherwise failed to use due care and caution under the circumstances. WHEREFORE, Plaintiffs demand judgment in the amount of $3,347.06, plus costs, interest, and any other relief that the court deems appropriate. COUNT II - Negligent Entrustment Matthew Harshbarger and Tara Harshbarger, h/w v. Mark Hamel 15. Paragraphs 1 through 14 are incorporated herein as if fully set forth below. 16. Defendant Mark Hamel negligently entrusted Defendant Yolanda Gauthier-Hamel with the use of his Hyundai Santa Fe. 17. Defendant Mark Hamel's negligent entrustment was the direct and proximate cause of the damage to the Plaintiffs' Chevrolet. 18. Defendant Mark Hamel otherwise failed to use due care and caution under the circumstances. WHEREFORE, Plaintiffs demand judgment in the amount of $3,347.06, plus costs, interest, and any other relief that the court deems appropriate. COUNT III - Vicarious Liability Matthew Harshbarger and Tara Harshbarger. h/w v. Mark Hamel 19. Paragraphs 1 through 18 are incorporated herein as if fully set forth below. 20. Defendant Mark Hamel permitted Yolanda Gauthier-Hamel, an unlicensed driver, to operate his vehicle in violation of 75 P.S. § 1574(a). 21. Defendant Yolanda Gauthier-Hamel's negligence was the direct and proximate cause of the damage to Plaintiffs' vehicle. 22. Defendant Mark Hamel is liable for Defendant Yolanda Gauthier-Hamel's negligence under a theory of vicarious liability.
