1. Samuel A. Schreckengaust, Jr. (the "Decedent"), died on March 30, 2008, leaving
a Last Will and Testament which was admitted to probate by the Register of Wills
of Cumberland County, Pennsylvania (the "Will").
2. Per Article V of the Will, the residue of the Decedent's Estate is distributable to
the Hershey Trust Company, the Trustee under the Decedent's Second Amended
and Restated Trust Agreement dated March 21, 2002 (the "Trust")
3. The Trust was a revocable trust established and funded by the Decedent during
his lifetime. At the time of the Decedent's death, the Trust held an investment
account with the Hershey Trust Company.
4. Per Article V(C) of the Trust Agreement, upon the Decedent's death, a Family
Trust is to be created and funded with a sum equal to the value that will produce a
federal estate tax prior to the use of the Decedent's available unified credit, the
credit for property previously taxed, and the state death tax credit.
5. The Family Trust is for the lifetime benefit of the Decedent's spouse, Barbara S.
Schreckengaust, who has the following interests in the Family Trust:
- Trust Income for her lifetime
- Discretionary principal distributions for her health, education, support, and
maintenance
6. Barbara S. Schreckengaust (the "Disclaimant") hereby disclaims her entire
interest in the Family Trust.
7. The Disclaimant has not received any benefits from the Family Trust, nor from
that portion of the Decedent's Estate that will be distributed to the Family Trust.
8. The Disclaimant shall deliver copies of this Disclaimer to Barbara S.
Schreckengaust, the Executor of the Decedent's Estate, to the Hershey Trust
Company, as Trustee of the Family Trust and the Decedent's Trust, and to Clerk
of the Cumberland County Court of Common Pleas, Orphans' Court Division, in
accordance with 20 PA C.S.A. §6204.
9. The Disclaimant has not received any consideration in money or money's worth
for such renunciation and disclaimer from any person or persons whose interest is
to be accelerated or increased, or from any other person or persons.
