Owner Contractor in the Court of Common Pleas, County of Cumberland , Pennsylvania Number Dq- qD? /:~,~ Term, 2004 Whereas, thc Owner is about to execute contemporaneously herewith, a contract, with said contractor, a corporation organized and existing under the laws of the State of Peunsylvania, for the General Construction work located within the lot of land situate in Silver Spring Township, Cumberland County, Pennsylvaixia. Being Lot No. 1 on the Major Final Subdivision Plan of 26 Lots "Stonecrest - Section I", recorded in Plan Book 56, Page 116, Cumberland County Recorder of Deeds Office. Being the same premises which Harold D. Stoner and Marilyn L. Stoner, husband and wife, by deed dated 15 September 1992, recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, granted and conveyed nnto Robert A. Bell and Suzanne L. Bell, his wife. Being the same premises which Almeda S. Ward, widow, by deed dated 31 March 1988 recorded in the Office of the Recorder of Deeds of Cumberland County, Pennsylvania in Deed Book G, Volume 33, Page 386, granted and conveyed unto Harold D. Stoner and Marilyn L. Stoner, his wife. Said property is also known and addressed as 17 Raspberry Drive, Mechanicsburg, Pennnsylvania. Now, Therefore, on February I ~' ,2004, at the time of and immediately before the execution of the principal contract, mad before any authority has been given by the said owner to the said contractor to commence work on the said project, or purchase materials for the same in consideration of the making of the said contract with the said contractor and the further consideration of One Dollar paid to the said contractor by the said owner, it is agreed that no mechanic's claims or other liens shall be filed against the building and/or ground appurtenant thereto by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased or furnished in connection with the construction of the said project or any part thereof, the right to file such liens being expressly waived and relinquished herewith.
