and between Lone Tree, Inc., of 4409 Carlisle Pike, Camp Hill,
Cumberland County, Pennsylvania, hereinafter referred to as
Contractor,
MICHAEL C. GOLDEN AND JOYCE A. McELVIE, hereinafter referred to as
Owners, whereby the contractor undertook and agreed to erect and
construct a dwelling on the certain lot of ground situate in North
Middleton Township, Cumberland County, Commonwealth of
Pennsylvania, and more fully described in Exhibit "A" which is
attached hereto and made a part hereof known as Lot #31 Long View,
Carlisle, Cumberland County, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

Exhibit A
All that certain plat, tract, parcel or lot of land located in North Middleton
Township, Cumberland County, Pennsylvania, bounded and described as follows, to
wit:
Beginning at a point on the southern right-of-way line of Long View (a fifty foot
right-of-way) said point being located North eighty-nine degrees, fifty-two minutes,
twenty seconds East (N 89° 52' 20" E), a distance of one hundred twenty-eight feet
(128.00') from the line of Cross Creek Development; thence from said point of
Beginning, by said right-of-way line of Long View the following three (3) courses; 1)
North eighty-nine degrees, fifty-two minutes, twenty seconds East (N 89° 52' 20" E),
a distance two and twenty-four hundredth feet (2.24') to a point; 2) by a curve to the
left, having a radius of two thousand, twenty-five feet (R = 2,025.00'), an arc
distance of fifty-nine and twenty-two hundredth feet (A/L = 59.22') to a point; 3)
North eighty-eight degrees, eleven minutes, forty-nine seconds East (N 88° 11' 49"
E), a distance of sixty-eight feet (68.00') to a point; thence by Lot No. 32 South one
degrees, forty-eight minutes, eleven seconds East (S 01° 48' 11" E), a distance of one
hundred Fifteen feet (115.00') to a point; thence by land now or late of Lawrence and
Suzette Foxx South eighty-eight degrees, eleven minutes, forty-nine seconds West (S
88° 11' 49" W), a distance of one hundred thirty-two and eighty-four hundredth feet
(132.84') to a point; thence by Lot No. 30 North zero degrees, seven minutes, thirty-
nine seconds West (N 00° 07' 39"W), a distance of one hundred Fifteen and ninety-
eight hundredth feet (115.98') to a point, the place of Beginning. Said tract contains
15,103 square feet or 0.347 acres.
