()'1- '131 ROBERT LONG and KATHY LONG, Owners. MECHANICS' LIEN MECHANICS' LIEN CLAIM Claimant, DONALD F. REISINGER, JR., d/b/a REISINGER CONSTRUCTION, by and through his legal counsel, Irwin & McKnight, files this claim against Robert Long and Kathy Long, and any other joint owner of record, and against the property, building and improvements erected thereon at 300 Belvedere Street, located in Carlisle, Cumberland County, Pennsylvania, 17013, for the payment of a debt due to Claimant as a contractor for the work and materials supplied in the erection and construction of a residence addition, including, but not limited to: excavating and pouring of footings; installation of a wine cellar; supplying and installation of double hung windows; supplying and installation of electrical wiring; supplying and installation of insulation and dry-walling, and makes the following statement: 1. The Claimant is Donald F. Reisinger, d/b/a Reisinger Construction, 1816 Sterretts Gap Avenue, Carlisle, Cumberland, County, Pennsylvania, 17013. 2. The reputed owners of the property at the time of furnishing the labor, goods and materials and the attaching of the lien therefor are Robert Long and Kathy Long ("the Owners"), and any other joint owner of record, with an address of 300 Belvedere Street, Carlisle, Cumberland County, Pennsylvania, 17013. 2 3. The Claimant, Donald F. Reisinger, Jr., d/b/a Reisinger Construction, contracted with the Owners on or about April 8, 2003. A true and correct copy of the proposal giving rise to the contract between the Claimant and the Owners is attached hereto and incorporated herein as Exhibit "A." 4. The work and materials hereinafter referred to were completed and furnished pursuant to the contract between the parties, until the Owners refused to continue to pay the Claimant for working on the project even though very little work was required to complete the project. 5. The improvements and the property which are subject to the claim is that property located at 300 Belvedere Street, Carlisle, Cumberland County, Pennsylvania, 17013., and improved with a commercial structure or structures. 6. The nature and character of the materials purchased pursuant to the contract were all materials and labor necessary for the erection and construction of a residence addition, including, but not limited to: excavating and pouring of footings; kitchen cabinetry, landscaping; supplying and installation of double hung windows, a patio, retaining wall and sidewalks; supplying and installation of electrical wiring; and supplying and installation of insulation and dry-walling, as provided in the proposal marked as Exhibit "A." 7. The original price for the materials and labor, specifically set forth in Exhibit "A," was Two Hundred Twenty Five Thousand Hundred and noli 00 ($225,000.00) Dollars. 8. The Owners also agreed to pay for and so directed Claimant to perform additional work at a cost above the original contract price. Additional work to be performed included the installation of a wine cellar. The total amount due to the Claimant totals One Hundred Sixty 3 Three Thousand Two Hundred Ninety and 58/100 ($163,290.58) Dollars. A copy of the chart summarizing the costs is attached hereto and incorporated herein as Exhibit "B." 9. Under the terms of the proposal giving rise to the contract, the Owners were required to make payment within ten (10) working days of the receipt ofthe invoice. 10. The amount or sum due as of December 31, 2003, for the labor, goods and materials provided by Claimant is One Hundred Sixty Three Thousand Two Hundred Ninety and 58/100 ($163,290.58) Dollars, plus applicable interest which has accrued since December 31, 2003. 11. Said outstanding sum is that amount unpaid under the originally agreed upon contract price and for the additional work for which the Owners agreed to pay above the original contract price and so directed Claimant to perform. 12. The last day on which work and materials were done and furnished was on or about December 24, 2003, which is less than four months from the date of the filing of this claim. 13. The labor, goods and materials are continuously furnished in and about the erection and construction of the residence addition, including: excavating and pouring of footings; supplying and installation of double hung windows, kitchen cabinetry, landscaping, a patio, a retaining wall and sidewalks; supplying and installation of electrical wiring; and supplying and installation of insulation and dry-walling at the property, located at 300 Belvedere Street, Carlisle, Cumberland County, Pennsylvania, 17013, constituting the premises subject to the lien. 4 14. This lien is claimed against the fee simple interest of the Owners of the aforesaid preIll1ses. WHEREFORE, Claimant claims this lien upon the premises herein described in the amount of One Hundred Sixty Three Thousand Two Hundred Ninety and no/lOO ($163,290.58) Dollars, plus applicable interest as provided by law, together with court costs, attorneys fees and other relief deemed just against the owners of said premises. B. Costs, including transportation, of materials and equipment incorporated or to be incorporated in the completed construction. .-'\11 discounts for cash or prompt payment shaU accme to the Cl1ntractor unless if before making the payment, the Contractor included them in an Application f('Ir Payment: and received payment therefor from the Owner, or the Owner has deposited flmds with the Contractor with which to make payments; otherwise, cash discOlmts shall accrue to the Contractor. E. Reasonable rental costs for necessary temporary facilities, machinery. equipment, and hand tools used at the site of the work, whether rented from the Contractor or others. F. Losses and expenses not compensated by insurance or otherwise, sustained by the Contractor -in connection "rith the work provided they have re:::nlted from causes other than the fault or neglect: of the Contractor. H. Costs of removal of debris from the site. I. Costs incurred in taking action to prevent threatened damage, injmy or loss: in case of an emergency affecting the safety of persons Dnd pr0perty. 1. Other costs incurred in the perfoffimflce of the Work if and to the extent approved in advance in writing by the Owner. 2 6, Costs Not To Be Reimbursed include: A. Salaries and other compensation of the Contractor's personnel stationed at the Contractor's principal office or offices other than the site oflice. B. Expenses of the Contractor's principal office and offices other than the site ofIice. C. Overhead and general expenses, except as may be expressly included in Paragraph <; D. TIle Contractor's capital expenses. including: interest on the contractor"s capital employed for the work. E. Rental CO:ilts of machincIY and equipment except as specifically provided in Paragraph 5. F. Except as provided in Paragraph 10 of this Agreement, costs due to the fault or negligence of the Contractor, Suhcontractors, anyone directly or indirectly employed by ~Uly of them, or tor whose acts any of them may be liable" including" but not limited to, costs for the correction of damaged, defective or nonconforrning work, disposal and replacement of materials and equipment incorrectly ordered or supplied, and making good damage to property not timning part of the work. TIle Contractor shall keep full and detailed aCcOlutts and exercise such controls as may be necessary for proper financial management under this Contract. The Owner and the Owner's accoWlhl1lts shall be afforded access to the contractor's records relating to this Contract. 8. The owner iilhall make Progress Payments on accoWlt of the Contract Sum to the Contractor upon receipt of Applications for Payment from the CClJltractor. The period covered by each invoice will be in accordance with the draw schedule approved by tJle owner's lending institution. The Owner must make progress payments within 10 working days of receipt of the invoice. Any unpaid paYIIIellts under the Contract shall bear interest from the date payment is due at an arumal percentage rate of 1 O~:O 9. If the Owner fails to make payment Oll an application for payment within 10 working days, through no tauH of the Contractor, the Contractor may, upon 7 additional days' written notice to the Owner, tenninate the ~ontract and rel.'OVer from the Owner pa:yment for all work executed and f('f proven loss with respect to materials, equipment, tools, and construction equipment and machinery, including reasonable cwerhead, profit and damages applicable to the project provided that in no event ghall such payment cause the Guaranteed Maximum cost to be exceeded. 10. The Owner will make final Payment upon receipt from the Contractor ofthe fmal Application for Payment.
