Yeatter Defendant CIVIL ACTION - COMPLAINT IN MORTGAGE FORECLOSURE And now comes Aurora Loan Services, LLC, by its attorneys, Zucker, Goldberg & Ackerman, LLC, and files this Complaint in Mortgage Foreclosure as follows: 1. The Plaintiff, Aurora Loan Services, LLC, which has its principal place of business at 601 Fifth Avenue, Scottsbluff, NE 69361. 2. The Defendant, James S. Yeatter, is an individual whose last known address is 2 Andes Drive, Mechanicsburg, PA 17055. 3. On or about March 30, 2007, James S. Yeatter executed a Note in favor of First Magnus Financial Corporation in the original principal amount of $170,000.00. Zucker, Goldberg & Ackerman, LLC XCP-103110 4. On or about March 30, 2007, as security for payment of the aforesaid Note, James S. Yeatter made, executed and delivered to Mortgage Electronic Registration Systems, Inc., as nominee for First Magnus Financial Corporation a Mortgage in the original principal amount of $170,000.00 on the premises hereinafter described, with said Mortgage being recorded in the Office of the Recorder of Deeds of Cumberland County on April 4, 2007, in Mortgage Book Volume 1987, Page 2604. A true and correct copy of said Mortgage containing a description of the premises subject to said Mortgage is marked Exhibit "A", attached hereto and made a part hereof. 5. The aforesaid Note and Mortgage was assigned by Mortgage Electronic Registration Systems, Inc., as nominee for First Magnus Financial Corporation to Aurora Loan Services, LLC, plaintiff herein, pursuant to an assignment of mortgage to be recorded. 6. Defendant is the record and real owner of the aforesaid mortgaged premises. 7. Defendant is in default under the terms of the aforesaid Mortgage and Note for, inter alia, failure to pay the monthly installments of principal and interest when due. 8. On or about April 3, 2008, Defendant was mailed a combined Notice of Homeowners' Emergency Mortgage Assistance Act of 1983 and Notice of Intention to Foreclose Mortgage, in compliance with the Homeowner's Emergency Mortgage Assistance Act, Act 91 of 1983 and Act 6 of 1974, 41 P. The amount due and owing Plaintiff by Defendant is as follows: Principal $ 169,475.07 Interest through 05/18/2008 $ 7,307.70 Attorneys' Fees $ 1,250.00 Title Costs $ 525.00 Late Charges $ 249.60 Recoverable Balance $ 114.00 Total $ 180,896.37 plus interest on the principal sum ($169,475.07) from May 18, 2008, at the rate of $53.43 per diem, plus additional late charges, and costs (including additional escrow advances), additional attorneys' fees and costs and for foreclosure and sale of the mortgaged premises. WHEREFORE, Plaintiff demands judgment in mortgage foreclosure for the amount due of $180,896.37, with interest thereon at the rate of $53.43 per diem from May 18, 2008, plus additional late charges, and costs (including additional escrow advances), additional attorneys' fees and costs and for foreclosure and sale of the mortgaged premises.
