THIS FAMILY SETTLEMENT AGREEMENT, executed this f
day of ~)!,~(.h~--~ , 2008, by and among CAROL ANN ESING,
individually and as parent and natural guardian for
Melissa L. Esing, LAURIE ANN MUSICO, individually and as
parent and natural guardian for Jacob S. Musico and
Jacqueline D. Musico, WILLIAM JOSEPH MUSICO, JENNIFER L.
STONER, BRIAN A. ESING and SARAH C. STONER,
WITNESSETH:
WHEREAS, Dorothy M. Musico, of Upper Allen Township,
Cumberland County, Pennsylvania, died on March 20, 2008 at
Messiah Village; and
WHEREAS, by her Last Will and Testament dated June 17,
1997 Dorothy M. Musico devised and bequeathed all of her
estate of every nature and wherever situate unto her four
(4) children, per stirpes; and

WHEREAS, Joan Marie Stoner, daughter of Dorothy M.
Musico died on July 17, 2004 and her estate was
administered in Cumberland County, Pennsylvania to Estate
No. 21-04-0698; and
WHEREAS, Joan Marie Stoner is survived by two
children, Jennifer L. Stoner, born May 12, 1986 and Sarah
C. Stoner, born March 21, 1988; and
WHEREAS, Carol Ann Esing, Laurie Ann Musico, and
William Joseph Musico all survived the death of their
Mother; and
WHEREAS, George J. Musico, husband of Dorothy M.
Musico, who was not named as beneficiary of her Will, but
could have elected against her Will, failed to do so and
died on April 25, 2008; and
WHEREAS, during her lifetime Dorothy M. Musico
maintained Pennsylvania 529 Guaranteed Savings (TAP) Plans
for Sarah C. Stoner, daughter of Joan Marie Stoner, born
March 21, 1998, Brian A. Esing, son of Carol Ann Esing,
born November 3, 1986, Melissa L. Esing, daughter of Carol
Ann Esing, born June 21, 1992, Jacqueline D. Musico, also
known as Jacqueline D. Shepp, born July 10, 2002, daughter
of Laurie Ann Musico, and Jacob S. Musico, also known as
Jacob S. Shepp, born July 10, 2002, son of Laurie Ann
Musico; and
WHEREAS, Dorothy M. Musico inadvertently failed to
designate a successor account owner on the above accounts,
in the event of her death, which, by operation of law would
vest ownership of the 529 Plans in the heirs of her estate
as aforesaid; and
WHEREAS, the heirs of Dorothy M. Musico under her Last
Will and Testament are all adult individuals and are in
unanimous agreement that it was Dorothy M. Musico's

intention that the 529 Plans be distributed to the
beneficiaries and are in an unanimous agreement to do so;
and
WHEREAS, at her death Dorothy M. Musico owned the 529
Plans, which are not subject to Pennsylvania Inheritance
Tax; and
WHEREAS, the parties are therefore in agreement to
probate the Last Will and Testament of Dorothy M. Musico
and contemporaneously file this Family Settlement Agreement
for the sole purpose of the transfer of the ownership of
the aforesaid Pennsylvania 529 Guaranteed Savings Plans to
her Grandchildren as she intended.
NOW, THEREFORE, the parties hereto, intending to be
legally bound hereby, do covenant and agree as follows:
1. Attached hereto, made a part hereof and designated
Exhibit "A" is a copy of the Last Will and Testament of
Dorothy M. Musico dated June 17, 1997, separately offered
for probate.
2. Attached hereto, made a part hereof, and
incorporated herein by reference thereto and designated
Exhibits "B" and "C" are Death Certificates for Dorothy M.
Musico and George J. Musico.
3. Ownership of the Pennsylvania 529 Guaranteed
Savings Plan account of Sarah C. Stoner, an adult
individual, account no. 0000105242 with a current account
balance of approximately $3,873 shall be transferred to
Sarah C. Stoner.
4. Ownership of the Pennsylvania 529 Guaranteed
Savings Plan account of Brian A. Esing, an adult
individual, account no. 0000091493 with a current account
balance of approximately $8,834 shall be transferred to
Brian A. Esing.

5. Ownership of the Pennsylvania 529 Guaranteed
Savings Plan account of Melissa L. Esing, a minor child,
account no. 0000091506 with a current account balance of
approximately $13,445 shall be transferred to Carol Ann
Esing, her Mother and natural guardian, for her benefit
until she attains the age of 18, at which time the account
shall be transferred unto Melissa L. Esing.
6. Ownership of the Pennsylvania 529 Guaranteed
Savings Plan account of Jacqueline D. Shepp, also known as
Jacqueline D. Musico, a minor child, account no.
00000066016 with a current balance of approximately
$2,575 shall be transferred to Laurie Ann Musico, her
Mother and natural guardian for her benefit until she
attains the age of 18, at which time the account shall be
transferred unto Jacqueline D. Shepp, also known as
Jacqueline D. Musico
7. Ownership of the Pennsylvania 529 Guaranteed
Savings Plan account of Jacob S. Shepp, also known as Jacob
S. Musico, a minor child, account no. 00000066028 with a
current balance of approximately $2,575 shall be
transferred to Laurie Ann Musico, his Mother and natural
guardian, for his benefit until he attains the age of 18,
at which time the account shall be transferred unto Jacob
S. Shepp, also known as Jacob S. Musico.
8. Anyone initiating a distribution from any of said
Pennsylvania 529 Guaranteed Savings Plans accounts which
result in any income tax liability is responsible
individually for the payment of such income tax liability,
and it shall not be the responsibility of the Estate or any
of the other individual parties hereto.
9. This Agreement shall constitute a Family Settlement

and shall be governed by the laws of the Commonwealth of
Pennsylvania and shall inure to the benefit of and be
binding upon the parties hereto, their heirs, executors,
administrators, successors and assigns.

Commonwe~th of Pennsylvania, being of sound and disposing mind, memory and
understanding, do make, publish and declare this as, and for'my Last Wi11 and Testament,
hereby revoking and making void all, former wills and codicils by me at any time heretofore
made.
1. ~ I order anal direct that all my debts and ~fuxteral expenses be paid 'by my
Executrix, I~reinafter named, as soon as conveniently may be done after my demise.

Executrix of his, my Last Will and Testament.

fidu~^zaries hereunder in carrying out and executing~my will.
5. ~ peath taxes: Atl federal, state anal other death taxes payable on the property

be paid out of the principal of my probstte estate just as if they wexe my debts, and none

any property over which I have a~ general power of appointment for federal estate tax
purposes.
