C"Vvo f c-ttt v. STEPHANIE BAER, Defendant CIVIL ACTION - LAW JURY TRIAL DEMANDED COMPLAINT IN CIVIL ACTION Plaintiff, Cindy L. Ryder, by and through her counsel, McCarthy Weisberg Cummings, P.C., hereby files the following Complaint in Civil Action (hereinafter, "Complaint") asserting a claim for damages against Defendant, Stephanie Baer, set forth herein, as follows: 1. Plaintiff, an adult individual, is a resident and citizen of the Commonwealth of Pennsylvania, residing at 334 East Garfield Street, Shippensburg, Cumberland County, Pennsylvania 17257. 2. Defendant Stephanie Baer, an adult individual, is a resident and citizen of the Commonwealth of Pennsylvania, residing at 337 East Garfield Street, Shippensburg, Cumberland County, Pennsylvania 17257. 3. At all times relevant and material hereto, Defendant was the owner, keeper and harborer of a dog, believed to be a golden retriever (hereinafter, the "Baer Dog"). 4. At all times relevant and material hereto, Plaintiff was the owner and keeper of a chihuahua breed of dog, named Pretzel (hereinafter, "Pretzel'). 5. On October 19, 2007, at approximately 4:15 p.m., Plaintiff was walking from her residence at 337 East Garfied Street, proceeding westward, with her dog, Pretzel, properly secured on a leash. 6. While Plaintiff was walking Pretzel, an unrestrained and unaccompanied golden retriever, later determined to be the Baer Dog, appeared from behind Plaintiff and violently, and without provocation attacked Pretzel. 7. Prior to the Baer Dog attacking Pretzel, Plaintiff had not walked in front of the Baer Dog's residence at 337 East Garfield Street; rather Plaintiff had left her own house and proceeded in the opposite direction. 8. While the Baer Dog was in the process of attacking Pretzel, and had Pretzel in its jaws, Plaintiff grabbed the Baer Dog by the collar to try to rescue Pretzel, and the Baer Dog let go of Pretzel. 9. Subsequently, the Baer Dog slipped out of its collar and attacked Pretzel again, grabbing Pretzel's entire body in its jaws. 10. Plaintiff was then able to kick the Baer Dog, which then dropped Pretzel, and Plaintiff was able to secure the collar back on the neck of the Baer Dog. 11. After Plaintiff secured the collar on the neck of the Baer Dog, the Baer Dog turned and bit Plaintiff three times on her right arm, just above her wrist, causing deep puncture wounds to Plaintiff's skin and causing her to bleed. 12. Immediately subsequent to the incident with the Baer Dog, Defendant advised Plaintiff that the Baer Dog had previously shown aggression towards other animals. 2 13. Upon information and belief, the Baer Dog had previously attacked another dog on at least one occasion. 14. Subsequent to the incident on October 19, 2007, Plaintiff has witnessed the Baer Dog roaming unaccompanied and unrestrained in the Plaintiffs neighborhood. 15. Subsequent to the incident on October 19, 2007, on February 26, 2008, Defendant was issued a warning by the Cumberland County Dog Warden for allowing the Baer Dog roaming unaccompanied and unrestrained in the Plaintiffs neighborhood. 16. Subsequent to the incident on October 19, 2007, on or about May 17, 2008, the Baer Dog attacked and bit another individual, Grace Russell, who resides next door to Defendant's residence. FIRST CAUSE OF ACTION: NEGLIGENCE, NEGLIGENCE PER SE. AND PUNITIVE DAMAGES 17. Plaintiff incorporates paragraphs 1-16 by reference as though fully set forth herein at length. 18. The Pennsylvania Dog Law, 3 P.S. § 459-305, provides: It shall be unlawful for the owner or keeper of any dog to fail to keep at all times such dog either: (1) confined within the premises of the owner; (2) firmly secured by means of a collar and chain or other device so that it cannot stray beyond the premises on which it is secured; or (3) under the reasonable control of some person, or when engaged 3 in lawful hunting, exhibition or field training. 19. This Act dictates the duties of care required of someone in the same situation as Defendant. 20. Defendant's conduct as described was in contravention of this Act. 21. This Act was intended to protect people in the same circumstances as Plaintiff was in, and to prevent the kind of harm that Plaintiff and Pretzel incurred. 22. Accordingly, Defendant was negligent as a matter of law. 23. Defendant's negligence as aforesaid was a substantial factor in bringing about harm to Plaintiff and Pretzel, including the injuries and damages as herein described. 24. In addition or in the alternative, the Defendant knew or should have known that her dog was vicious and had a propensity to attack other animals and human beings without provocation, based on one or more of the following: (a) It is believed, and therefore averred, that the Baer Dog was previously known to be aggressive and demonstrate vicious tendencies towards other animals. (b) It is believed, and therefore averred, that the Baer Dog had previously attacked another dog on at least one occasion. (c) It is believed, and therefore averred, that the Baer Dog had previously been neutered in an attempt to make it friendlier, which was unsuccessful. (d) It is believed, and therefore averred, that the Baer Dog had previously, without provocation, growled at children in the neighborhood. 4 (e) It is believed, and therefore averred, that the Baer Dog had previously, without provocation, bared its teeth towards other people in the neighborhood. (f) It is believed, and therefore averred, that Defendant had previously given away the Baer Dog to another individual due to its aggressive nature, but later took back ownership and control of the Baer Dog. 25. Defendant was further careless, negligent, reckless and outrageous in allowing the Baer Dog to attack Plaintiff and Pretzel, despite all of the foregoing knowledge, by acting or failing to act in one or more of the following respects: (a) In keeping the Baer Dog on the subject premises when she knew or should have known that the dog was vicious, aggressive and dangerous, all in violation of the Dog Law and/or local regulations and ordinances; (b) In failing to properly and adequately confine and restrain the Baer Dog well away from Plaintiff and Pretzel while they were on a public walkway; (c) In failing to utilize proper and adequate materials to chain or otherwise restrain the Baer Dog well away from Plaintiff and Pretzel while they were on a public walkway; (d) In failing to properly restrain and/or muzzle the Baer Dog; (e) In failing to warn Plaintiff that the Baer Dog possessed known dangerous and vicious propensities; (f) In failing to warn Plaintiff that the Baer Dog was not restrained and/or otherwise could reach and attack the Plaintiff and Pretzel; 5 (g) In failing to take adequate precautions to ensure that the Baer Dog was properly secured and restrained, and could not break its restraints or otherwise reach Plaintiff and Pretzel; (h) In failing to supervise and maintain a close watch over the Baer Dog; (i) In failing to adequately, timely, and properly and completely inspect the premises where the Baer Dog was housed to ensure the Baer Dog could not escape; 0) in failing to care for and train the Baer Dog; (k) In failing to keep and maintain the Baer Dog in a safe place; (1) In causing and allowing a dangerous and hazardous situation to exist; (m) In failing to use the degree of care required of Defendant as an owner, controller, and/or possessor of the vicious dog under the circumstances then and there existing; (n) In violating various provisions of the Pennsylvania Dog Law; (o) In failing to have the Baer Dog properly licensed with the county; (p) In failing to have the Baer Dog vaccinated against rabies; (q) In failing to take remedial action subsequent to the Baer Dog attacking Plaintiff and Pretzel, such that the Baer Dog has been allowed to roam free in the neighborhood subsequent to the incident of October 19, 2007; 6 (r) In failing to take remedial action subsequent to the Baer Dog attacking Plaintiff and Pretzel, such that the Baer Dog was able to attack and bite another neighbor on or about May 17, 2008; (s) In being otherwise careless, reckless, negligent and wanton as may appear in the course of discovery and/or trial of this cause; and (t) In creating conditions or otherwise encouraging the Baer Dog to be aggressive toward human beings. 26. As a direct and proximate result of the carelessness, negligent, reckless and outrageous conduct of Defendant as aforesaid, Plaintiff has sustained the following damages and injuries, some of which may be continuing or permanent in nature or effect: (a) Animal bites creating puncture wounds to the right arm; (b) Scarring to the right arm; (c) Laceration to the right wrist; (d) Severe fright, anxiety, mental anguish, embarrassment and humiliation; (e) Severe pain and suffering; (f) Severe loss of the enjoyment of life and overall health and well being; (g) Plaintiff has been forced to spend large sums of money for doctors, medicines, hospitals, medical treatment and other medical expenses. (h) Plaintiff has been forced to spend large sums of money for veterinary care and treatment for Pretzel, including two surgical repairs of 7 abdominal hernias and a fracture to the back right ankle. 27. All of the aforesaid injuries and damages have continued from October 19, 2007 to the present, and will continue into the future. 28. The aforesaid conduct of Defendant was outrageous, reckless, willful and malicious, and constituted deliberate acts and omissions having a high probability of harm with a reckless indifference to the consequences, by reason of which Plaintiff is entitled to punitive damages. WHEREFORE, Plaintiff claims damages against Defendant Baer in a compensatory and punitive sum both in excess of the arbitration limits of the court, plus interest and costs of suit. Defendant was not negligent, reckless, or careless with respect to any conduct regarding the injuries and damages alleged by Plaintiff. 31. Plaintiff's claims are barred or limited by Plaintiff's own contributory negligence, including, but not limited to, attempting to re-collar Defendant's dog, which exacerbated the situation which directly resulted in Plaintiff's injuries, and failing to disengage from the situation. 33.
