AMEN. t~ n ?.7 fl . _ I_ ~_ . , .. _, f' J -5 •=-~ c -s C~ .y.. -r-.. w ~~ ~~ I, Thomas Edward O'Donnell, Jr. of x.05 Penn Ayr Road, Hampden Township, Camp Hill, Cumberland County, State of Pennsylvania (17011) being of sound and disposing mind, memory and understanding, and capable of executing a valid deed or contract, considering the certainty of death and the uncertainty of the time thereof, and being desirous to settle my worldly affairs, and thereby be the better prepared to leave this world when it shall please the Almighty to call me hence, do hereby make, publish and declare this my last Will and Testament, hereby revoking and annulling all wills and testamentary dispositions heretofore made by me, in manner and form following, that is to say: FIRST, and principally, I commit my soul into the hands of Almighty God, and my body to the earth, to be decently buried at the discretion of my co-executors hereinafter named; and my will is, that all my just debts and funeral expenses, without regard to statutory limitation or amount, shall be paid by my co-executors hereinafter named as soon after my decease as shall be convenient: SECOND, I give, devise and bequeath to an eye bank (which my co-executors hereinafter named shall designate) both my eyes for any legitimate purposes such bank, in its discretion, may deem appropriate: THIRD, I give, devise and bequeath to my beloved wife, Alice Elizabeth, all my furniture, clothing, jewelry, pictures, statuary, works of art, silver plate, ornaments, brit-a-brae, tapestry, household goods or supplies, linen, china, glass, automobiles, horses, boats, and coin and stamp collections, together with all personal effects which I may own at the time of my death, including all policies of insurance thereon: FOURTH, if any principal of my estate shall become distributable to a minor, my co-executors hereinafter named may in their absolute discretion pay over such principal at any time to the guardian of the property of such minor, or retain the same for such minor during his (or her) minority. In case of such retention, my co-executors hereinafter named may apply such principal and the income therefrom to the support, maintenance, and education of such minor, either directly or by payments to the guardian of the property or person of such minor or to the person with whom such minor may reside, in any form of cash without requiring any bond; and the receipt by any such person shall be a complete discharge to my co-executors hereinafter named who shall not be bound to see to the application of any such payment. Any unapplied principal and income shall be paid over to such legatee upon his (or her) attainin majority, or if he (or she) shall die before attaining majority, to his (or her) estate. In holding any funds for any minor, my co-executors hereinafter named shall have all the powers and discretions hereinafter cor~,ferred upon them• Page 1 of 2 -_ .~°!~~' Pages ~ ~-"-`'' Page 2 of 2 Pages All the rest and residue of my estate, both real, personal and mixed, I give, devise and bequeath to my beloved wife, Alice Elizabeth, or if she does not survive me, to my surviving issue, per stirpes: For the purposes of this will, if there is not sufficient evidence that my said wife and I died otherwise than simultaneously, then it shall be presumed that my wife survived me: And Lastly, I do hereby nominate, constitute and appoint my brother-in-law and attorney, Thomas Joseph Amy, Esq., and my brother-in-law, LeRoy Victor Amy, Jr., co-executors of this, my last Will and Testament, and I desire that my co-executors hereinbefore named shall not be required to give bond for the faithful performance of the duties of that office. I have been appointed as Executor of my late brother-in-Law's estate (Thomas Edward O'Donnell, Jr.). He died on March 5, 2008. While the deceased was a resident of Carlisle, PA, I reside out-of- state in Denver, Colorado.
