DaWALL AND CA~0LE S. DeWALL, husband and wife, hereinafter referred to as Owners, whereby the contractor undertook and agreed to erected and construct a dwelling on the certain lot of ground situate in the Borough of Carlisle, Cumberland County, Commonwealth of Pennsylvania, and more fully described in Exhibit "A" which is attached hereto alld made a part hereof known as 330 Acre Drive, Carlisle, PA 17013. NOW %-m~REFORE, THIS AGREEMENT WXTNESSETH~ That the said Contractor, for an in consideration of the sum of ($1.00} Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, a~d the further consideration mentioned in the agreement aforesaid, for itself, himself or themselves and its, his or their subcontractors, and all parties acting throBgh or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by ~hem or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for itself, himself or themselves, its, his or their subcontractors and others under them, hereby e~pressly waive and relinquish the right to have, file, and msintain any mechanic,s liens or claims a~ainst the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Exhibit A ALL THOSE certain two tracts of land situate in the Borough of Carlisle and South Middleton Township, Cumberland County, Pennsylvania, bounded and described as follows: TRACT NO. 1: ALL THAT CERTAIN parcel or tract of land situate in the Borough of Carlisle, Third Ward, Cumberland County, Pennsylvania, bounded and described as follows: BEGINNING at an iron pin set on the southerly right of way line of Acre Drive (60' R/W), said iron pin also being at the northwest corner of land now or formerly of Jack IL and Jane Arthurs; thence following along said land now or formerly of Jack IL and Jane H. Arthurs, South 21 degrees, 00 minutes, 49 seconds West, a distance of 160.27 feet to an iron pin on the Borough of Carlisle and South Middleton Township Corporate Line and at corners of said land now or formerly of Jack IL and Jane H. Victor and recorded in Cumberland County Plan Book 87, Page 132; thence by land now or formerly of Carl C. Wert, et al. South 03 degrees 14 minutes 11 seconds East 50 feet to a point; thence by land now or formerly of Rodney IC Hough, et ux., North 82 degrees 54 minutes 02 seconds West 100 feet to an iron pin; thence by the same North 03 degrees 14 minutes 11 seconds West 50 feet to an iron pin on the southern line of Tract No. 1 hereof; thence by said Tract No. I South 82 degrees 54 minutes 02 seconds East 100 feet to an iron pin, the place of BEGINNING.
