II I direct that all my just debts and funeral expenses shall be paid from my residuary estate as soon as practicable after my decease. III I direct that all taxes that may be assessed in consequence of my death, of whatever nature and by whatever jurisdiction imposed, shall be paid from my residuary estate as a part of the expense of the administration of my estate. IV I give and bequeath the sum of SIXTY-THREE THOUSAND ($63,000.00) DOLLARS to HELEN FELTY, per stirpes. V I give and bequeath the sum of SIXTY-THREE THOUSAND ($63,000.00) DOLLARS to GRACE FELTY ADAMS, per stirpes. VI I give and bequeath the sum of ONE HUNDRED THOUSAND ($100,000.00) DOLLARS to ALICE M. MILLER. XII TRUST I appoint, MURREL R. WALTERS, III, as Trustee of the funds that I have given to BETHANY VILLAGE, ST. MARK'S EVANGELICAL LUTHERAN CHURCH, BETHESDA MISSION, and MOUNTAIN VIEW BIBLE CHURCH. A. The assets that are transferred to the Trust shall be divided into separate shares for each of the beneficiaries. ~. The trust estate shall be administered for a period of five (5) years from the date of my death. ~' C . Each year the beneficiaries shall receive the annual net income from their respective shares, distributed at least on an annual basis. D. The principal from each share shall be paid to the beneficiaries at the rate of Twenty (20~) Percent annually over 3 twenty-five percent (25%) to my grandniece, DIANE BRAUN, per stirpes. VII I give and bequeath the sum of ONE HUNDRED THOUSAND ($100,000.00) DOLLARS to VIOLET M. STOUFFER. If VIOLET fails to survive me, her share shall be divided twenty-five percent (25%) to the legatees listed in paragraph VI, twenty-five percent {25%) to the legatees listed in paragraph VIII, twenty-five percent (25%) to the legatees listed in paragraph IX, and twenty-five percent (25%) to the legatees listed in paragraph X. VIII I give and bequeath the sum of ONE HUNDRED THOUSAND ($100,000.00) DOLLARS to ROBERT MEYER, JAMES MEYER, DAVID MEYER, and RONALD MEYER, in equal shares, per stirpes. IX I give and bequeath the sum of ONE HUNDRED THOUSAND ($100,000.00) DOLLARS to WAYNE ~. SMITH. If this bequeath should lapse, it shall be divided equally among his son, LARRY SMITH, his son, CURTIS SMITH, his daughter, JANEL ZAWATSKI, and his daughter, BONNIE BLAUCH, per stirpes. X I give and bequeath the sum of ONE HUNDRED THOUSAND ($100,000.00) DOLLARS to ROMAINE SMITH. If ROMAINE should predecease me, then this bequest shall be divided twenty-five percent (25%) to the legatees listed in paragraph VI, twenty-five percent (25%) to the legatees listed in paragraph VII, twenty-five percent (25%) to the legatees listed in paragraph VIII, and twenty-five percent (25%) to the legatees listed in paragraph IX. XI A11 the rest, residue and remainder of my property, whether real or personal, wherever situate, including any property over which I may have a power of appointment, I give, devise and bequeath as follows: 2 the five (5) year period. E. In order to carry out the purposes of this Trust established by this Will, the Trustee, in addition to all other powers granted by this Will, or by law, shall have the following powers over the Trust estate, subject to any limitation specified elsewhere in this Will: 1) To retain any property received by the Trust estate for as long as the Trustee considers it advisable. ~/2) To spend funds for the maintenance and repair of real property. 3) To sell at public or private sale, exchange or lease for a period of time, any real or personal property and give options for sale of the lease. 4) To execute and deliver any deeds, leases, assignments or other instruments as may be necessary to carry out the provisions of this Trust. 5) To borrow money and to mortgage or pledge any real or personal property. 6) The Trustee shall maintain accurate records and accounts and shall render statements to my beneficiary hereunder showing receipts and disbursements of principal and income no less frequently than annually. The Trustee shall serve without bond and shall receive fair and reasonable compensation for administration of this Trust, not to exceed five (5~) percent of annual income. 7) To distribute property in kind. 8) To do all other acts that are in his judgment necessary or desirable for the proper management, investment and distribution of the Trust estate. XIII I nominate, constitute and appoint my nephew, DAVID L. MEYER, as Executor of this LAST WILL, to serve without bond. If DAVID is unable or unwilling to act in that capacity, then I nominate, constitute and appoint my nephew, RONALD J. MEYER, as Executor, to serve without bond. 4 IN WITNESS WHEREOF, I, MILDRED E.
