HORNBERGER This report is being sent to all people named as beneficiaries in the Last Will and Testament of Emma C. Hornberger. A complete copy of the Will is attached. In this informal report the significant aspects of the Will and how the estate has been settled are discussed. The intention of this report is to show that the provisions of the Will have been carved out and that all expenses, disbursements, etc. have been handled properly and are documented. The details are shown on the attached spreadsheets. If you want to discuss any part of this report please call me. In addition, know that copies of the bills that were paid, etc. are on file at the county courthouse and that you have a right to inspect these papers. These records are in a department called the Register of Wills and Clerk of Orphans Court. Now, comments on specific items of the Will. Item 2. The sister Julia Sprenkle passed away about 4 years ago. The other siblings listed are still living. Item 2. Nothing here became relevant except to note again that 3ulia did not survive Emma. Item 3. Instructions were followed. Item 4. Instructions were followed. Item 5. Regarding the distribution of tangible property. Tangible property is property that you can see and touch such as furtuture, dishes and jewelry. A recurring theme of the Will and of previous POA documents is that that Emma's desire was to leave the majority of her tangible belongings to her sisters Julia and Leah. But the other beneficiaries were to be remembered by allowing them to take any items that were special to them. This desire has been honored at all times as her property was disposed of both before and after her death. In particular, earlier, when she moved from her house into Country Meadows retirement facility, her house, most furnishings and many personal items were sold. Essentially all of the remaining furnishings and personal items were given to sister Leah. At that time the other beneficiaries were given an opportunity to take miscellaneous items of particular interest. There were few takers. When Emma moved from Country Meadows to Manor Care nursing facility for more advanced care, additional downsizing was required and again essentially everything was given to Leah with minor items to some others. As a consequence of this prior gifting and selling of her property, Emma had no tangible property other than a small amount of clothing and a few personal care items when she died. This was all offered to Leah who kept a few clothing items. Everything else went to Good Will or was thrown away. Item 6. There were no special bequests. Item 7- Residuary Estate and Item S- Alternate Residuary Estate. Everything that Emma possessed that was not a tangible item covered by 5 and 6 above is an intangible item covered by this term Residuary Estate. So this includes items such as her money in the bank, certificates of deposit, insurance policies (none), money owed to her and similar things. These intangible items are all listed on the attached copy of the SCHEDULE E that was included as part of the Inheritance Tax return package. The total of these assets was $3Q8,756.12. This money was used to pay all final bills, the inheritance tax, other taxes, etc. It is not the amount that was available for distribution to beneficiaries. The money that was available for distributions is detailed in the attached notes covering the Estate checking account. Under Item 7 these financial items were to be combined to set up a Trust for the benefit of Julia and Leah. Then, under Item 8, upon the death of Julia and Leah, the trust would be eliminated and the proceeds would go to the other beneficiaries, Donald, Ronald and Harry. Item 9. Trust Provisions. This item provides more details of how the trust (set up by Item 7) would be operated. Note that it might appear to you that a page is missing from your copy of the Will. Looking at "Page 5", you see that page 5 includes subsections b, c, d, and e of Item 9. The next page, with "Page 6" clearly shown at the bottom, has subsections j and k. What became of subsections f, g, h, and i? It turns out that this is a typing or organization error. Somehow, in the process of writing and revising the Will, the lettering of subsections just got mixed up. I called the courthouse and they verified that the original of the will did not contain any other page between 5 and 6 that just did not have a page number. Note also that at the bottom of page 6 there is a subsection "a." which seems to be misnamed. You do indeed have a complete copy of the Will. Now, back to the Trust idea. The most significant thing to note is that a trust never was established. This is because Julia died before Emma. This left only Leah as a beneficiary of the proposed trust. However, Leah renounced her rights to the Estate and the Trust. A copy of her renunciation is attached. Please refer to subsection k. of this Item 9. This is on page 6. This subsection directs that the trust be terminated when both beneficiaries die, or when both beneficiaries renounce their interests. Clearly there is no way for "both" of them to do either thing if one of them is already deceased. Then only the remaining survivor need die or renounce the trust for it to be terminated. But what should be done if the last beneficiary renounces the trust before one has ever been set up? I reviewed this with Emma's long time attorney, Ms. Diane Radcliff, who has provided guidance to me as I settled this estate. Her conclusion is that the establishment of a trust has become a moot issue. It simply is no longer relevant in this situation and the estate should be divided among the alternate, or residuary beneficiaries. Item 14. This appointment of a Trustee for the Trust became a moot issue because the trust was not needed. Item 11. This was never necessary. Item 12. This named me as the Personal Representative (which is also called the Executor) of Emma's estate. Item 13. As directed all taxes on the estate were paid by the estate. Item 14. No special comments are needed. Many of the subsections never applied. Item 15. No comment needed. Item 16. All beneficiaries except sister 3ulia did survive Emma for more than 30 days. Item 17. No comment needed. Item 18. No comment needed. That completes my comments on the Will. I have a few additional comments. My renuncaation. For the last few years of Emma's life I handled her financial affairs under the terms of the Power of Attorney she had granted me. In particular, I was a joint owner of her checking, saving, and money market accounts at Members 1~`. I had to be a joint owner so I could transfer money between accounts when needed and pay her bills for the nursing home, insurance and other things. Shortly before she died a large CD came due and the money was deposited into the money market account. This could have paid her nursing home bill for an entire year. When she died I automatically became owner of all accounts where I was previously a joint owner. These accounts totaled $66,133.57. I know that Emma never intended that I should receive a large amount like that due to an accident of timing. Consequently I renounced all rights to this money and all money in all bank accounts was transferred into the new estate account. A copy of my renunciation is attached. Payments to Executor. I have taken only one payment from the estate to compensate me for my time. That payment was $500.00 in 200b. C}therwise I have taken only payments that reimbursed me for my direct out of pocket expenses. Two attached spreadsheets show all of these expenses except for a few that I didn't keep track of. Total expenses were approximately $345. List of checking account transactions. An attached spreadsheet lists every transaction of her estate checking account. This account started with check number 97. There are no details related to the CD's. They were all deposited into the estate checking account and were distributed via that accourrt. Distributions from the Estate. The distributions are all included in the list of checks- This completes my informal report on the settlement of Emma's estate. Si erely, Ronald P. The first section is the expenses through 5/23/07 which is the date the payment of the inheritance tax was made. Executor was reimbursed for these out of pocket expenses on 5/23 via check 122 from the estate checking account. These first expenses totaled $198.43. In addition, Executor was reimbursed via check 105 on 11/14/06 for the $414.00 of probate costs which were paid out-of pocket, The second section is expenses after 5123. $These total 133.22 and were covered by check 130 on 7/4/08. In addition to these expenses, Executor was paid a fee of $500.00 (check 106 on 11/14/06) as compensation for the time spent in settling estate matters in 2006.
