WARNER VS CHRISTOPHER L. DYE JESSICA G. WARNER CUMBERLAND COUNTY, PENNSYLVANIA STIPULATION AGAINST LIENS WHEREAS CHRISTOPHER L. DYE AND JESSICA G. WARNER entered into a contract with CHRIST AND , to provide materials and/or to perform labor necessary for the construction and erection or the alteration and repair of (a) building(s) upon those certain pieces or parcels of land situated in NORTH NEWTON TOWNSHIP , CUMBERLAND County, Pennsylvania, being more particularly bounded and described as follows: Deed from Interfaith Housing Alliance, Inc. Dated and intended to be recorded preceding the recording of this stipulation to Christopher L. Dye and Jessica G. Warner. NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said contract and for the consideration therein set forth, that neither the undersigned contractor, any sub-contractor or materialman, nor any other person furnishing labor or material to the said contractor under this contract shall file a lien, commonly called a mechanic's lien, for work done or materials furnished to the said building or any part thereof. This stipulation is made and intended to be filed with the County Prothonotary within ten (10) days after date, in accordance with the requirements of Act of Assembly of Pennsylvania, in such case provided (49 P.S. 1402). WA ER '"" Exhibit A tr ALL that tract of land in North Newton Township, Cumberland County, Pennsylvania, being more particularly described as follows: BEGINNING at an iron pin set in the eastern right-of--way line of the Heim Court cul-de- sac at corner of Lot 5 on the hereinafter described subdivision plan; thence by said Lot 5, same, South 49 degrees 39 minutes 43 seconds East, 124.26 feet to an iron pin set at corner of existing concrete pad and well; thence by said existing concrete pad and well, South 22 degrees 30 minutes 49 seconds East, 40.00 feet to an existing post at corner of land now or formerly of Kenneth B. Lehman; thence by said land now or formerly of Kenneth B. Lehman, South 66 degrees 40 minutes 36 seconds West, 194.95 feet to a set concrete monument; thence by same, North 52 degrees 06 minutes 16 seconds West, 35.00 feet to an iron pin set at corner of Lot 7 on the hereinafter described subdivision plan; thence by said Lot 7, North 10 degrees 42 minutes 43 seconds West, 182.75 feet to an iron pin set on the right-of--way line for the Heim Court cul-de-sac; thence in and along the Heim Court cul-de-sac, by a curve to the left on a circle having a radius of 60.00 feet, an arc distance of 65.49 feet, and a long chord bearing of North 48 degrees O1 minute 17 seconds East, 62.28 feet to an iron pin set; the place of BEGINNING. The above description was taken from a final subdivision plan for W. Irvin Nelson and Jason E. Garner, dated August 19, 2005, and revised December 1, 2005, prepared by Eric L. Diffenbaugh, Professional Land Surveyor, which plan is recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan Book 92, at page 40.
