JONES MICHAEL A. JONES vs LINDSEY R. JONES MICHAEL A. JONES STIPULATION AGAINST LIENS WHEREAS LINDSEY R. JONES ANA MICHAEL A. JONES entered into a contract with LINDSEY R. J AND MICHAEL A. J to provide materials and/or to perform labor necessary for the construction and erection or the alteration and repair of (a) building(s) upon those certain pieces or parcels of land situated in NORTH NEWTON TOWNSHIP CUMBERLAND County, Pennsylvania, being more particularly bounded and described as follows: Deed from Interfaith Housing Alliance, Inc. Dated and intended to be recorded preceding the recording of this stipulation to Lindsey R. Jones and Michael A. Jones. NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said contract and for the consideration therein set forth, that neither the undersigned contractor, any sub-contractor or materialman, nor any other person furnishing labor or material to the said contractor under this contract shall file a lien, commonly called a mechanic's lien, for work done or materials furnished to the said building or any part thereof. This stipulation is made and intended to be filed with the County Prothonotary within ten (10) days after date, in accordance with the requirements of Act of Assembly of Pennsylvania, in such case provided (49 P.S. 1402). IN WITNESS WHEREOF, the said parties hereto have hereunto set their hand and seal this ~.'?~ day of (Position 6) ~ (SEAL ) MI AEL A. 0 'S I ,• Exhibit A ALL THAT tract of land in North Newton Township, Cumberland County, Pennsylvania, being more particulazly described as follows: BEGINNING at an iron pin set in the eastern right of way line for Heim Court at the westernmost corner of Lot 4 on the hereinafter described subdivision plan; thence along of Lot 2 on the hereinafter described subdivision plan; thence by said Lot 2 and Lot 1, Tract 1, South 19 degrees 58 minutes 51 seconds East, 71.32 feet to an iron pin set at corner of unopened alley; thence by said unopened alley, South 20 degrees 13 minutes 09 seconds East, 54.74 feet to an iron pin set at corner of existing concrete pad and well; thence by said existing concrete pad and well, North 67 degrees 29 minutes 11 seconds East, 44.73 feet to an iron pin set at corner of Lot 6 on the hereinafter described subdivision plan; thence by said Lot 6, North 49 degrees 39 minutes 43 seconds West, 124.26 feet to an iron pin set; thence by same, North 60 degrees 15 minutes 32 seconds West, 97.06 feet to an iron pin set in the eastern right of way line for Heim Court; thence in and along the right of way line of Heim Court by a curve to the left on a circle having a radius of 60.00 feet, an azc distance of 37.18 feet and a long chord bearing of North O1 degrees 17 minutes 42 seconds West, 37.51 feet to an iron pin set; thence by same, by a curve to the right on a circle having a radius of 30.00 feet, an azc distance of 27.40 feet, and a long chord bearing of North 06 degrees 49 minutes 12 seconds East, 26.46 feet to an iron pin set; thence by same, North 32 degrees 59 minutes OS seconds East, 25.05 feet to an iron pin set; thence by the same, by a curve to the left on a circle having a radius of 225.00 feet, an arc distance of 12.74 feet, and a long chord bearing of North 31 degrees 21 minutes 49 seconds, East, 12.74 feet to an iron pin set at corner of Lot 4 on the hereinafter described subdivision plan, the place of BEGINNING. THE ABOVE DESCRIPTION was taken from a final subdivision plan for W. Irvin Nelson. and Jason_ E_- Garner, dated August. 19, 2005,- and-.revised- December.. 1,..2005,- prepazed by Eric L. Diffenbaugh, PLS., which plan is recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 92, at Page 40.
