Dugan of 6126 Charing Cross, Mechanicsburg, isabouttoexecutecontemporaneously herewith, a contract, with Carlson Construction, of 1085 Country club Road, Camp Hill, Pennsylvania, Pennsylvania, for the erection of a stor~ building upon a lot of land situate Lot 60 Hampden Summit, 1207 Summit Way, Mechanicsburg, Hampden Township, Cumberland County, Pennsylvania as more specifically described in Exhibit "A" which is incorporated herein and attached hereto. NOW. March 9, 2004 ~ . at the time of and immediately before the execution of the prin- cipal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One Dollar. to Contractor paid by Owner , it is agreed that no lien shall be filed against the &uilding by the contractor, or any sub. contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. Dugan ~] ~-- EXHIBIT "A" ALL THAT CERTAIN tract or parcel of land being situate in Township of Hampden, County of Cumberland, Commonwealth of Pennsylvania, more particularly bounded and described as follows: BEGINNING at a point on the northern fight of way line of Summit Way, that is located at the southwestern corner of Lot No. 59 being the southeastern corner of Lot No. 60; thence along the northern right of way line of Summit Way North 64 degrees 58 minutes 3 seconds West, by a distance of 14.80 feet to a point; thence along the same on a curve to the left with a radius of 425 feet with an arc length of 91.62 feet having a chord with a distance 91.44 feet and a chord bearing North 71 degrees 8 minutes 35 seconds West to a point; thence along Lot No. 61 North I0 degrees 46 minutes 50 seconds East by a distance of 148.23 feet to a point; thence along Lot No. R, North 85 degrees 45 minutes 24 seconds East by a distance of 75.62 feet to a point; thence along the same South 89 degrees 51 minutes 46 seconds East by a distance of 25.86 feet to a point; thence along Lot No. 95, South 72 degrees 8 minutes 35 seconds East by a distance of 53.20 feet to a point; thence along Lot No. 59 South 25 degrees 1 mutes 57 seconds West, by a distance of 188.34 feet to a point on the northern right of way line of Summit Way, the place of BEGINNING.
