HomeMy WebLinkAbout04-1059STIPULATION AGAINST LIENS LAWMEN CONSTRUCTION, LLC, Owner versus LAWMEN CONSTRUCTION, LLC, ContracWr IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA Oq- 10£9 MLD TERM Whereas, LA WMEN CONSTRUCTION, LLC, a Pennsylvania Limited Liability Company, of 149 Kerrs Road, Carlisle, Cumberland County, Pennsylvania is about to execute contemporaneously herewith, a contract with LA WMEN CONSTRUCTION, LLC, a Pennsylvania Limited Liability Company, of 149 Kerrs Road, Carlisle, Cumberland County, Pennsylvania, for the erection ora residential dwelling house upon a lot of land situate in Penn Township, Cumberland County, Pennsylvania, being known as Lot No. 13, Final Subdivision Plan for Maple Grove (Phase 2), as recorded in Cumberland County Plan Book 79, Page 80. Legal Description: BEGINNING at a point along the northern side of Fox Hollow Lane at the dividing line between Lots 13 and 14 as set forth on the hereinafter referenced Final Subdivision Plan; thence along said dividing line North 04 degrees 04 minutes 49 seconds East 243.22 feet to a point; thence along the dividing line between Lots 12 and 13 on the hereinafter referenced Final Subdivision Plan South 85 degrees 55 minutes 12 seconds East 365.00 feet to a point; thence along the northern side of Fox Hollow Lane South 04 degrees 04 minutes 48 seconds West 68,22 feet to a set concrete monument; thence continuing along the same on a line curving to the right having a radius of 175.00 feet and an arc of 274.89 feet to a set concrete monument; thence continuing along the same North 85 degrees 55 minutes 12 seconds West 190.00 feet to a point, the place of BEGINNING. Now, March 10, 2004, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with it and the further consideration of one Dollar, to Contractor paid by Owner it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
