STIPULATION AGAINST LIENS
WHEREAS, Hogan Development Company iII of Lancaster, Pennsylvania, has entered
into a contract with Hogan Residential Ync. Contractor, to provide materials and perform
labor necessary for the construction of dwelling units and improvements upon a tract of
ground situate at:
ALL THAT CERTAIN lot or parcel of real estate, situate in Hampden Township,
Cumberland County, Pennsylvania, being more particularly bounded and described as
follows:
BEGINNING at a concrete monument on the western legal right-of--way line of Valley
Road (L.R. 21051) at the southeast corner of Lot No. 2 on the hereinafter described Final
Subdivision Plan; thence along the western legal right-of-way line of Valley Raad (L.R.
21051) South 20 degrees 17 minutes 00 seconds West a distance of 150.00 feet to a paint
on the northern line of lands now or formerly of Marlin E. and Nancy E. Blust; thence
slang the narthern line of lands now or formerly Marlin E. and Nancy E. Blurt, the
following three (3) courses and distances: (1) North 87 degrees 43 minutes OS seconds
West a distance of 216.96 feet; (2) North 11 degrees O1 minute 55 seconds East a
distance of 15.40 feet; and (3) North 88 degrees 43 minutes 20 seconds West a distance
of 796.50 feet to a point at the eastern line of other lands of Fallow Field; thence along
the eastern line of other lands of Fallow field North 13 degrees 18 minutes 10 seconds
West a distance of 1,232.31 feet to a point at the southern line of lands now or formerly
of Victor H. Blust Estate; thence along the southern line of lands now or formerly of
Victor H. Blurt Estate North 82 degrees 12 minutes S5 seconds East a distance of 499.95
feet; thence continuing along the same North 70 degrees 57 minutes 55 seconds East a
distance of 59.12 feet to a point on the western line of lands now or formerly of Victor H.
Blurt Estate; thence along the same South 42 degrees 10 minutes 35 seconds East a
distance of 989.88 feet to a point on the northern corner of Lot Na. 2 on the hereinafter
described Final Subdivision Plan; thence along the western line of said Lot No. 2 south
47 degrees 49 minutes 25 seconds West a distance of 315.00 feet to a point; thence along
the western line of said Lot No. 2 south 26 degrees 39 minutes 26 seconds East a distance
of 259.32 feet to a~point; thence along the southern line of said Lot No. 2 South 87
degrees 43 minutes 06 seconds East a distance of 247.20 feet to a concrete monument at
the western legal right-of--way line of Valley Road, the point and place of Beginning.

thence along the northern line of Lot No. 1 North 87 degrees 43 minutes 06 seconds West
a distance of 247.20 feet to a point at the eastern line of said Lot No. 1; thence along the
eastern line of said Lot No. 1 North 26 degrees 39 minutes 26 seconds West a distance of
259.32 feet to a point on the southern line of said Lot No. 1; thence along the same North
47 degrees 49 minutes East a distance of 315.00 feet to a point on the southern line of
lands now or formerly of Victor H. Blust Estate; thence along the same South 42 degrees
10 minutes 35 seconds East a distance of 372.64 feet to a point on the western legal right-
of--way line of Valley Road (L.R 21051); thence along the western legal right-of-way
line of Valley Road (L.R. 21051) by a curve to the left having a radius of 270 feet a
distance of 169.51 feet to a point; thence continuing along the western legal right-of--way
line of Valley Road (L.R. 21051) South 20 degrees 17 minutes 00 seconds West a
distance of 49.08 feet to a point at the northeast corner of Lot No. 1 on the hereinafter
described Final Subdivision Plan, the point and place of Beginning.
CONTAINING: 3.00 acres
BEING KNOWN AS TAX ACCOUNT NUMBER: 10-13-0997-017A
BEING THE SAME PREMISES which High Family Partnership I, a Pennsylvania
Limited Partnership by its deed dated October 7, 2005 and recorded October 17, 2005 in
the Office of the Recorder of Deeds in and for Cumberland County, PA in Record Book
271, Page 2348 granted and conveyed unto Hogan Development Company, III, a PA
General Partnership.
NOW THEREFORE, it is hereby stipulated and agreed by and between the said parties,
as part of the said contract and for the consideration therein set forkh, that neither the
undersigned contractor, any sub-contractor or material man, nor any other person
furnishing labor or materials to the said contractor under this contract shall file a lien,
commonly called a mechanic's lien, for work done or materials furnished to the said
building or any part thereof.
THIS STIPULATION is made and intended to be filed with the County Prothonotary in
accordance with the requirements of Section 1402 of the Mechanics' Lien Law of 3963
of the Commonwealth of Pennsylvania in such case provided.
