THOMAS, d/b/a THOMAS CONSTRUCTION, Contractor IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA NO. t9 q- lo-lo STIPULATION AGAINST LIENS WHEREAS, F.A.S.T. PARTNERS, LP ("Owner"), the Owner of the real estate described herein has executed a Contract dated "' with RICHARD C. THOMAS, d/b/a THOMAS CONSTRUCTION ("Contractor"), whose principal place o£business is located at 155 Ken-Lin Drive, Carlisle, PA 17013, for the construction of certain improvements to said real estate situate at Lot Nos. 2 and 3, Hampden Summit, Silver Spring Township, Cumberland County, Pennsylvania as more particularly bounded and described on Exhibit "A", attached hereto and made a part hereof; and NOW, THEREFORE, this I I ~/~ day of March, 2004, before any authority had been given by Owner to Contractor to commence work on said facilities or purchase materials for same, in consideration of making of the above-described Contract between Owner and Contractor, and in further consideration of One ($1.00) Dollar paid to Contractor by Owner, the receipt whereof is hereby acknowledged and intending to be legally bound hereby, it is agreed that no liens or claims shall be filed or maintained against the Owner's facilities and the land described herein or any interest of Owner therein by the Contractor or any of its subcontractors, or by any of the materialmen or workmen, or any other person acting through or under them, for or on account of any labor or materials purchased, or extra labor or materials purchased for, towards, in or abut the erection, construction, design and improvement of said facilities, under said contract or otherwise, the right to have, file and maintain such liens or claims against the facilities and the land described herein, being hereby expressly waived by the Contractor for itself, its subcontractors, all materialmen, or workmen and other acting through or under them. THOMAS~ d/b/a By:TI]~ 2 EXHIBIT "A" LOT NO. 2, HAMPDEN SUMMIT ALL that certain tract of land situated in Hampden Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows: BEGINNiNG at a point on the southern right-of-way line of Summit Way, being the northwestern comer of Lot No. 1; thence along Lot No. 1 South 00°48'16" East by a distance of 197.27', (erroneously labeled on the recorded subdivision plan as South 00°45'26" East by a distance of 196.98') to a point; thence along the lands now or formerly of Donald L. Basehore South 89°11 '44" West by a distance of 108.00' to a point; thence along Lot No. 3 North 00°48'16" West by a distance of 146.00' (erroneously labeled on the recorded subdivision plan as North 01°01'56" West by a distance of 145.62') to a point on the southern right-of-way line of Summit Way; thence along the southern right-of-way line of Summit Way North 56° I 0'47" East by a distance of 103.52' to a point; thence along the same on a curve to the right with a radius of 15.00' with an arc length of 24.42' having a chord with a distance of 21.81' and a chord bearing South 77°11 '27" East to a point; the place of BEGINNiNG.
