ORDER
AND NOW, this q ~ day of ~,,.l~ , 20Q8, based upon the Petition to
iRemove Co-Executrix and Order Vacation of Decedent's Residence and further based upon the
agreement and stipulation of the Petitioner Virginia L. Conklin and Respondents Joanne L.
Bodley and Francisco Cesar Torres, it is hereby ORDERED as follows:
1. The hearing scheduled by this Court under Order dated June 20, 2008 to take place
~at 3:30 o'clock p.m. on July 10, 2008 is hereby cancelled.
2. Respondent Joanne L. Bodley, either alone or with Francisco Cesar Torres, shall

refinance the existing Countrywide mortgage on the property at 809 Flintlock Ridge Road,
Mechanicsburg (the "Property") into her or their names on or before August 29, 2008. At or by
the time of refinancing Joanne L. Bodley or Joanne L. Bodley and Francisco Cesar Torres shall
pay the Estate of Margaret B. Young the sum of $8,800.00 for administration expenses and
Virginia L. Conklin the sum of $19,250.00, with such payments to be made by certified funds or
~~~ by checks issued from a title insurance agency account and delivered to Samuel L. Andes,
Esquire on or before August 29, 20Q8.
3. Petitioner Virginia L. Conklin, as Co-Executrix of the Estate of Margaret B. Young,

agrees to cooperate in the refinancing of tl,1e Property by signing any necessaocum~Yts

required by the lender to facilitate the refinancing. ~''~' --

4. In the event the refinancing does not occur and the payments are not made on or
before August 29, 2008 in accordance with item 2, above, upon certification of same by
Petitioner's attorney to this Court, an Order shall be issued by this Court immediately removing
Joanne L. Bodley as Co-Executrix of the Estate of Margaret B. Young and authorizing Virginia
~L. Conklin to serve as the sole Executrix of the Estate of Margaret B. Young and ordering and
(directing that the Property at 809 Flintlock Ridge Road, Mechanicsburg, Pennsylvania be
(vacated by both Joanne L. Bodley and Francisco Cesar Torres by September 29, 2008 and all of
(their personal possessions and furnishings be removed therefrom by September 29, 2008.
