In connection with the appointment of your Petitioner as Successor Trustee a surety bond was issued by the Aetna Casualty and Surety Company in the amount of $15,000.00 dated April 25, 1997. The Petitioner as Co-Executor of the estate filed a First & Final Account with the Court for the period of January 27, 1995 to January 9, 1996 setting forth a proposed distribution to Devon Miller, a minor, of $9525.76 and to Derek Miller, a minor, in the amount of $9,525.76. A copy of said account is attached hereto and incorporated herein by reference and marked Exhibit "C". 5. The Petitioner invested the minor's distributive share of the Estate of Janet H. Machan by depositing half of each distributive share with Templeton Investments Franklin Insured Tax Free Income Fund, to account number 121-12120665784 for Derek Miller and account number 121-12120665796 for Devon Miller. 6. Your Petitioner deposited the other half of each minors' distributive share of the Estate of Janet H. Machan in Washington Mutual Investors Fund A, to account number 62499993 for Derek Miller and to account number 6499994 for Devon Miller. 7. Derek Miller, who resides at 817 Rubel Avenue, Apartment 3, Louisville KY 40204, was born on February 9, 1986 and has now reached the age of twenty-one (21), the date of distribution set forth in the Decedent's Will. The Trustee made distribution pursuant thereto to Derek Miller on or about July 1, 2008 in the amount of $16,986.93, representing the final liquidation value of the investments set forth in paragraphs five (5) and six (6) above. Devon Miller, who resides at 204 Tamarack Road, Richmond, VA 23229, was born on August 31, 1988 and is now in her second year of college. The Petitioner made distribution to her in accordance with Item Four of the Decedent's Last Will and Testament pursuant to the direction to apply income and principal to the legatees college education. Distribution of the proceeds of the liquidation of the accounts of Devon Miller as set forth in paragraphs five (5) and six (6) above, was made on or about June 16, 1998 in the amount of $16,986.93 and is set forth in the copies of redemption checks which are attached hereto and marked Exhibit "E" . 9. The entire Estate of Janet H. Machan has now been distributed to all creditors and parties entitled thereto and there is no other property belonging to the estate or to the beneficiaries of the trusts. 10. The Trustees Summary Accounting is attached hereto and marked Exhibit "F" . 11. The Trustee having satisfied her fiduciary duties to invest and protect the accounts of the minors until they either reach the age of majority or the funds were otherwise distributable in accordance with the settlor's Will, and having distributed the balance of said accounts in their entirety to the minors who have now reached the age of majority, the Trustee requests that she be discharged as Fiduciary, and that the surety bond be terminated. 3 ~ ~ Y WHEREFORE, the Petitioner, Diane L. On July 31, 2008, your Petitioner filed a Petition for Discharge of Fiduciary and Surety related to testamentary trusts set up for Derek Miller and Devon Miller, who at the time of the deceased death were minors. 2. By Order of August 5, 2008, a citation was issued to the said Derek Miller and Devon Miller, beneficiaries of the trust for minors set up in the Last Will and Testament of Janet H. Machan, to show cause why the Petition should not be approved and the Trustee and the surety discharged. The Citation was returnable on or before August 29, 2008. 3. The Petition and Citation were served upon Devon Miller and Derek Miller by the Clerk of the Orphan's Court, on August 5, 2008. A copy of the Certificate of Service is attached hereto and marked Exhibit "A" . 4.
