LAST WILL AND TESTAMENT
OF
FLORENCE G. RADASKY
I, FLORENCE G. RADASKY, of Hampden Township, Cumberland County,
Pennsylvania, being of sound and disposing mind, memory and understanding, do hereby
make, publish and declare this as and for my Last Will and Testament, hereby revoking all
other wills and codicils heretofore made by me.
FIRST: I direct that all my just debts and funeral expenses, including my
grave marker, shah be paid from the assets of my estate as soon as practicable after my
decease.
SECOND: I give, devise and bequeath the residue of my estate, of every
nature and wherever situate, to my Husband, ALBERT G. RADASKY, providing he shall
survive me by thirty (30) days.
THIRD: Should my Husband, ALBERT G. RADASKY, predecease me
or die on or before the thirtieth day following my death, I give and bequeath all of my
personal belongings including my clothing, furs, jewelry and sterling silver (flatware and
coffee service), Wedgewood china and all crystal to my daughter, CAROL J. McELROY.
FOURTH: Should my Husband, ALBERT G. RADASKY, predecease me
or die on or before the thirtieth day following my death, I give, devise and bequeath sixty
percent of the residue of my estate, of every nature and wherever situate, to be divided equally
between my granddaughters, namely, CHRISTI j. RADASKy, KENDY A. RADASKY,
HEATHER M. Mc. ELROY, CANDICE McELROY, BRITT W. RADASKY and BO J.
RADASKY, who are living on the thirty-first day following my death.
FIFTH: Should my Husband, ALBERT G. RADASKY, predecease me
or die on or before the thirtieth day following my death, I give, devise and bequeath twenty
percent of the residue of my estate, of every nature and wherever situate, to my son,
WILLIAM A. RADASKY, provided that should my son, WILLIAM A. RADASKY,
predecease me or die on or before the thirteenth day following my death his share shall be
distributed to his issue per stripes, living on the thirty-f~rst day following my death.
SIXTH: Should my Husband, ALBERT G. RADASKY, predecease me
or die on or before the thirtieth day following my death, I give, devise and bequeath twenty
percent of the residue of my estate, of every nature and wherever situate, to my daughter,
CAROL J. McELROY, provided that should my daughter, CAROL J. McELROY,
predecease me or die on or before the thirteenth day following my death her share shall be
distributed to her issue per stripes, living on the thirty-first day following my death.
SEVENTH: I direct that all taxes that may be assessed in consequence of my
death, of whatever nature and by whatever jurisdiction imposed, shall be paid from my
residuary estate as a part of the expense of the administration of my estate.
EIGHTH: I nominate, constitute and appoint my Husband, ALBERT G.
RADASKY, Executor of this my Last Will and Testament. Should my Husband, ALBERT G.
RADASKY, fail to qualify or cease to act as Executor, I appoint my children, WILLIAM A.
RADASKY and CAROL McELROY, Executors of this my Last Will and Testament.
NINTH: I direct my Executor and his successors shall not be required to
give bond for the faithful performance of their duties in this or any other jurisdiction.
IN WITNESS WHEREOF, I have hereunto set my hand and seal to this, my Last

The motion of William A. Radasky and Carol J. McElroy, Executors of the estate of Florence
G. Radasky, respectfully represents that:
1. Petitioners are the Executors of the Estate of Florence G. Radasky who died testate on
December 7, 2003.
2. As per Item Fourth of her will, Florence G. Radasky gave a share of her estate to each
of her grandchildren. [A copy of the Will is attached hereto as Exhibit A]
3. Britt W. Radasky and Bo J. Radasky are granddaughters and the daughters of a deceased
son of the decedent. Subsequent to the son's death, their mother married Thomas J. Hundley and by
a judgment of adoption by the Circuit Court for Baltimore County dated November 12, 1999 both
children were adopted by Thomas J. Hundley and their names were legally changed to Britt Whitney
Radasky Hundley and Bo Jessica Hundley.
4. Britt W. Hundley was born April 14, 1990 and is 14 years old and Bo J. Hundley was
born December 14, 1994 and is 10 years old.
5. The Schedule of Proposed Distribution to be filed in this estate provides for each of these
children to receive the sum of $28,314.12.
6. {}5306 of the Pennsylvania Probate Estate and Fiduciaries Code, 20 Pa. C.S.A. {}5306
permits a Personal Representative to make an irrevocable transfer to another adult as custodian for the
benefit of a minor under a Will that does not contain an authorization to do so if the Personal
Representative considers the transfer to be in the best interest of the minor(s); the transfer is not
prohibited by or inconsistent with provisions of the applicable will; and the transfer is authorized b y
the Court if it exceeds $10,000 in value.
7. The undersigned Executors of the estate believe a transfer of each minor's share to
Margaret S. Hundley, Custodian for [named child] under the PennsylvaniaUniform Transfers to Minors
Act would be in the best interest of the children because it would provide greater flexibility in the
investment of the funds, and the safeguarding of the funds until each minor heir attains 21 years of age.
8. A transfer of each minor's share to Margaret S. Hundley, Custodian for [named child]
under the Pennsylvania Uniform Transfers to Minors Act would not be inconsistent with the Will of
Florence G. Radasky.
WHEREFORE, William A. Radasky and Carol J. McElroy, Executors of the Estate of Florence
G. Radasky, request this Court to enter an Order authorizing them to make distribution for the minors,
Britt W.R. Hundley and Bo J. Hundley by making distribution as follows:

Section 9140).

REFUND (CA): A refund of a tax credit, which ubs not requested on the Tax Return, may be requested by completing an "Application
for Refund of Pennsylvania Inheritance and Estate Tax" (REV-1513). Applications are available at the Office
of the Register of Hills, any of the 23 Revenue District Offices, or by calling the special Z4-hour
answering service for forms ordering: 1-800-36Z-ZO50~ services for taxpayers with special hearing and / or
speaking needs: 1-800-qq7-3020 (TT only).
OBJECTIONS: Any party in interest not satisfied with the appraisement, alloeance, or disallowance of deductions, or assessment
of tax (including discount ar interest) as shown on this Notice must object within sixty (60) days of receipt of
this Notice by:
--written protest to the PA Department of Revenue, Board of Appeals, Dept. ZB1OZ1, Harrisburg, PA 171ZB-1OZ1, OR
--election to have the matter determined at audit of the account of the personal representative, OR
--appeal to the Orphans' Court.

CORRECTIONS: Factual errors discovered on this assessment should be addressed in writing to: PA Department of Revenue,

Phone (717) 787-6S05. See page 5 of the booklet "Instructions for Inheritance Tax Return for a Resident
Decedent" (REV-1501) for an explanation of administratively correctable errors.
DISCOUNT: If any tax due is paid within three (5) calendar months after the decedent's death, a five percent (5X) discount of
the tax paid is BiloBed.
PENALTY: The 15Z tax amnesty non-participation penalty is computed on the total of the tax and interest assessed, and not
paid before January lB, 1996, the first day after the and of the tax amnesty period. This non-participation
penalty is appealable in the same manner and in the the same time period as you mould appeal the tax and interest
that has been assessed as indicated on this notice.
INTEREST: Interest is charged beginning aith first day of delinquency, or nine (9) months and one (1) day from the date of
death, to the date of payment. Taxes which became delinquent before January 1, 19BI bear interest at the rate of
six (6X) percent par annum calculated at a daily rate of .000164. AIl taxes which became delinquent on and after
January l, 198Z will bear interest at a rate which will vary from calendar year to calendar year with that rate
announced by the PA Department of Revenue. The applicable interest rates for 198Z through ZOO4 are:
