In support of this Petition, the Petitioner avers as follows: On July 10, 2008 Petitioner (Kellie Lynn McInroy) resumed her maiden name by filing notice. (See Notice to Resume Prior Surname and Birth Certificate of Petitioner attached hereto and marked as Exhibit "A") 2. The Petitioner was born Kellie Lynn McInroy on September 27, 1964 in Lowell, Massachusetts and currently resides at 901 Allenview Drive, Mechanicsburg, Cumberland County, Pennsylvania with The Minor. (See Exhibit "A" and copy of Petitioner's Pennsylvania driver's license attached hereto and marked Exhibit `B"). 3. The Petitioner and Anthony T. D'Alessandro were married on June 18, 2002 in the Commonwealth of Puerto Rico. (See Marriage Certificate attached hereto and marked Exhibit "C'). 4. On December 04, 2002 Mara Lindsay D'Alessandro (The Minor) was born to Father Anthony T. D'Alessandro and Mother (Petitioner) Kellie Lynn McInroy (formerly also "D'Alessandro") at the Milton S. Hershey Medical Center in Dauphin County, Pennsylvania. (See Birth Certificate of Minor attached hereto and marked Exhibit "D"). 5. The Petitioner and Anthony T. D'Alessandro were divorced by Decree ordered October 31, 2006 in the Court of Common Pleas of Cumberland County. (See Divorce Decree attached hereto and marked Exhibit "E") 6. No formal custody agreement is in place for the custody and care of The Minor, but by agreement of the parties the Petitioner has undertaken the role of the primary caregiver with physical custody of The Minor here in Mechanicsburg, Cumberland County, Pennsylvania. 7. Anthony T. D'Alessandro (father of The Minor) relocated from the Commonwealth and currently resides at 10136 East Southern Avenue, Mesa, Arizona 35209. 8. On April 9, 2007, Anthony T. D'Alessandro consented to a change of The Minor's name to "Mara Lindsay D'Alessandro McInroy". (See April 9, 2007 memorandum attached hereto and marked Exhibit "F'). 9. The Petitioner and The Minor live at 901 Allenview Drive, Mechanicsburg, Cumberland County, Pennsylvania and are in the jurisdiction of this Court. 10. The Minor is reaching school-age and the best interests of The Minor would be served if she shared the last name of the Mother with whom she resides in Cumberland County, Pennsylvania. 11. The Minor's best interests would be served if she had the same last name as her Mother (Petitioner) as she could be readily identified in school, at work, and in other situations as the daughter of Kellie Lynn McInroy, Petitioner. 12. Anthony T. D'Alessandro is being be provided notice of the date, time, and place of any hearing on this petition in order to afford him ample opportunity to respond and/or appear should he desire to do so. (See Notices attached by addendum at the time of the hearing marked as Exhibit "G`). 13. Anthony T.
