NOTICE UNDER THE FAIR DEBT COLLECTION PRACTICES ACT,
15 U.S.C. §1601 (AS AMENDED)
THE PENNSYLVANIA UNFAIR TRADE PRACTICES ACT
AND CONSUMER PROTECTION LAW,
73 PA.CON.STAT.ANN. §201, ET. SEQ. ("THE ACTS")
INASMUCH AS THE ACTS MAY APPLY, PLEASE BE ADVISED
THAT THIS COMMUNICATION IS FROM A DEBT COLLECTOR.
THIS IS AN ATTEMPT TO COLLECT A DEBT AND ANY
INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE
COMPLAINT
The Plaintiff, Erie Insurance Exchange by its attorney Paul F. D'Emilio, Esquire,
bring this action upon a cause whereof the following is a statement:
The Plaintiff, Erie Insurance Exchange, ("Erie") is a Corporation authorized to do
business in the Commonwealth of Pennsylvania, having an mailing address of P.O. Box
2013, Mechanicsburg, PA 17055.
Plaintiff brings this action as subrogee of Benjamin Smart III ("Insured") under a
policy of homeowners insurance issued by Plaintiff.
2. Defendant, Joseph Keefer, is an individual residing at 244 North Enola Drive,
Enola, PA 17025 and was the real and registered owner of premises 244 North Enola
Drive, Enola, PA 17025.
3. On or about June 3, 2007, the Defendant Joseph Keefer carelessly discarded a
cigarette starting a fire at 244 North Enola Drive, Enola, PA 17025, which is a home
next to the Insured's home at 246 North Enola Drive, Enola, PA 17025
4. Plaintiff avers that the personal Property of the Insured was damaged as a
result of the occurrence hereinbefore mentioned, the reasonable costs of repairs the
dwelling thereto being is One Thousand Nine Hundred Thirty Eight 40/100
($1,938.40) Dollars plus the Insured's deductible of Five Hundred and 00/100
($500.00) Dollars for a total of Two Thousand Four Hundred Thirty Eight and
40/100 ($2,438.40) Dollars. A true and correct copy of the estimate which is attached
hereto, made part hereof and marked Exhibit °A."
5. The said occurrence was due to the negligence of the Defendant, Joseph
Keefer, in that he:
a. allowed a fire to start in the property without due regard for the rights,
safety and position of the Insured's property;
b. negligently failed to ensure the safety of the Insured's property;
C. allowed a fire to start in the premises;
d. allowed a fire at the premises to cause damage to the Insured's property;
e. failed to take proper precautions against starting a fire;
f. carelessly discarded a cigarette;
g. did fail to use due care under the circumstances; and
h. did violate the various statutes and laws of the County of Cumberland
County, and Commonwealth of Pennsylvania.
WHEREFORE, Plaintiff demands judgment against the Defendants upon each
count in an amount not in excess of FIFTY THOUSAND AND 00/100 ($50,000.00)
DOLLARS together with costs of suit.
