WHEREAS, SCOTT C. PENWELL and KR'ISTEN C. PENWELL of 1114 Tunbridge Lane,
Mechanicsburg, Pennsylvania, is about to execute contemporaneously herewith, a contract, with YINGST
HOMES, INC. of 4712 Smith Street, Harrisburg, Pennsylvania, for the erection of a building upon
premises commonly known as LOT 5 MAGARO HILLS, Township EAST PENNSBORO,
CUMBERLADN County, Pennsylvania, as set forth in the deed dated January 15,2004 , recorded at
Deed Book 261 , Page 2168 , in the Recorder's Office for CUMBERLADN County, Pennsylvania,
as more specifically described in Exhibit "A" which is incorporated herein and attached hereto.
NOV~ ,March 18 ,. 2006 , at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor to commence
work on the said building, or purchase materials for the same in consideration of the making of the said
contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner,
it is agreed that no lien shall be fried against the building by the Contractor, or any subcontractor, nor by
any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra
labor or materials purchased for the erection of said building, the right to file such liens being expressly
waived.
WITNESS, our hands and seals the day and year aforesaid.

ALL THAT CERTAIN lot or parcel of land situate in East Pennsboro Township, Cumberland
County, Pennsylvania, being lot 5 on a Final Subdivision Plan of Magaro Hills, recorded on
December 12, 2003, in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, in Plan Book 88, Page 40 (the "Plan"), more particularly bounded and described on
Exhibit "A" attached hereto and made a part hereof for all purposes the same as if set forth at length.
BEGINNING at a point on the northern Right of Way for Wolfe Road a~d tho southeast
comer of the lands N/F of Lee and Kafh~n ~w~yer (DB t26, Page 780); thence along the lands
NIF of Lee and Katlllyn Sawyer (OB 126, Page 780) N 15°26'23' W a distance of 228.56' to a
Point, ~aid point being the ~outhwest comer of Lot 1; thence along Lot '1 N 80°19'25' E a clistance
of 149.62' to a ~inf, said point being the northwest comer of Lot 4; thence along Lot 4 S
t7°.56'21- E a distance of 228.72' tq a point, said point being on the northern Right of Way for
Wolfe Road; thence along the northern Right of Way for Wolfe Road $ 81°25'11 TM W a distance of
93.86' to a point, salt/point being on the northern Right of Way for Wolfe Road: thence along the
same on a curve to the lef~ with a radius of 525.00', an am length of 65.80', a chord 0eating of S
77°49'46' W and a chord length of 65.75' to a point, said point being the place of beginning.
