RENTSCHLER Defendants COMPLAINT The Plaintiff, LEXIS NEXIS MARTIN DALE-HUBBELL, A DIVISION OF REED ELSEVIER, INC., by its attorneys, KODAK & IMBLUM, P.C., brings this action of Assumpsit against the Defendant to recover the sum of SEVEN THOUSAND EIGHT HUNDRED FORTY-TWO DOLLARS AND TWENTY-EIGHT CENTS ($7,842.28), along with interest thereon at the statutory rate from February 15, 2008, upon a cause of action of which the following is a statement: 1. The Plaintiff, LEXIS NEXIS MARTINDALE-HUBBELL, A DIVISION OF REED ELSEVIER, INC., is a corporation organized and existing under the laws of the State of Massachusetts, having its principal office and place of business at 121 Chanlon Road, New Providence, NJ 07974. 2. The Defendant, MICHAEL D. RENTSCHLER individually and trading as LAW OFFICE OF MICHAEL D. RENTSCHLER, is an adult individual with a principal F:\USER\ROBIN\CCP&DJ CMPS\CCP COMPLAINTS\MARTINDALE HUBBELL. LEXIS NEXIS\MARTINDALE HUBBELL 34032.wpd 2 place of business at 28 North 32"1 Street, Camp Hill, Cumberland County, Pennsylvania 17011. 3. On or about April 19, 2005, Defendant entered into a contract with Plaintiff whereby Plaintiff would provide advertising and lawyer listings for Defendant in Plaintiffs publication for the 2006 edition. A true and correct copy of said contract is attached hereto, marked Exhibit "A" and made a part hereof. 4. On or about September 12, 2006, Defendant renewed said contract with Plaintiff whereby Plaintiff would provide advertising and lawyer listings for Defendant in Plaintiffs publication for the 2007 year. A true and correct copy of said contract is attached hereto, marked Exhibit "B" and made a part hereof. 5. The prices charged for said services provided were just and reasonable, were the legal and market prices therefor and were the prices which the Defendant contractually promised and agreed to pay to Plaintiff. 6. Defendant defaulted underthe terms and conditions of the aforesaid 2006 and 2007 contracts attached hereto as Exhibits "A" and "B" by failing, refusing or neglecting to pay to Plaintiff the amounts due and owing. 7. The balance due and owing by Defendant to Plaintiff is the sum of Six Thousand Seven Hundred One Dollars and Ninety Cents ($6,701.90), as appears by Plaintiffs Statement of Account attached hereto, marked Exhibit "C" and made a part hereof. 8. Due to the default of Defendant, and pursuant to the terms and conditions of the Contracts executed by Defendant and attached hereto as Exhibits "A" and "B", attorney's fees in the total amount of One Thousand Three Hundred Forty Dollars and Thirty-Eight Cents ($1,340.38) have been added to said account. 9. Defendant acknowledged the aforesaid debt to Plaintiff by entering into a payment plan with Plaintiff's counsel and paying to Plaintiffs counsel his first installment payment of Two Hundred Dollars ($200.00) as shown on Exhibit "D" attached hereto and made a part hereof. Credit is being given herewith to Defendant against the balance due to Plaintiff. 10. Plaintiff frequently demanded payment from Defendant of said amount due and owing as aforesaid, but Defendant refused and neglected and still refuses and neglects to pay said amount or any part thereof. WHEREFORE, Plaintiff brings this suit to recover from Defendant the sum of SEVEN THOUSAND EIGHT HUNDRED FORTY-TWO DOLLARS AND TWENTY-EIGHT CENTS ($7,842.28), together with interest as set forth herein.
