COMPLAINT IN MORTGAGE FORECLOSURE
1. Plaintiff is NATIONAL CITY MORTGAGE INC., F/K/A NATIONAL CITY MORTGAGE
COMPANY, 3232 New Mark Drive, Miamisburg, OH 45342.
2. The names and addresses of the Defendant is GARY L. CHRONISTER, 4989 Amelias Path East,
Mechanicsburg, PA 17050, who is the mortgagor and real owner of the mortgaged premises hereinafter
described. Original mortgagor Jean Chronister died December 2, 2006 and is hereby released of liability
on the debt secure by the mortgage.
3. On June 17, 2002 mortgagors made, executed and delivered a mortgage upon the Property hereinafter
described to NATIONAL CITY MORTGAGE COMPANY, which mortgage is recorded in the Office
of the Recorder of Deeds of Cumberland County as Book 1762, Page 2580. The Mortgage and
assignment(s) are matters of public record and are incorporated by this reference in accordance wi?h
Pennsylvania Rule of Civil Procedure 1019(g); which Rule relieves the Plaintiff from its obligation to
attach documents to pleadings if those documents are matters of public record.
4. The Property subject to the Mortgage is more fully described in the legal description set forth as Exhibit
"A" ("Property")
5. The mortgage is in default because the monthly payments of principal and interest are due and unpaid
for April 01, 2008 and each month thereafter and by the terms of the Mortgage, upon default in such
payments for a period of one month or more, the entire principal balance and all interest due and other
charges are due and collectible.
6. The following amounts are due to Plaintiff on the Mortgage:

7. If the Mortgage is reinstated prior to a Sheriff's Sale, the Attorney's Fees set forth above may be less
than the amount demanded based on work actually performed. The Attorney's Fees requested arel in
conformity with the Mortgage and Pennsylvania law. Plaintiff is entitled to collect Attorney's fees of up
to 5% of the remaining principal balance in the event the Property is sold to a third party purchaser at
Sheriff's Sale or if the complexity of the action requires additional fees in excess of the amount
demanded in the Action.
Plaintiff is not seeking a judgment of personal liability (or an "in personam" judgment) against the
Defendant in this Action but reserves its right to bring a separate Action to establish that right, if such
right exists. If Defendant has received a discharge of their personal liability in a Bankruptcy proceeding,
this Action of Mortgage Foreclosure is, in no way, an attempt to re-establish the personal liability that
was discharged in Bankruptcy, but only to foreclose the Mortgage and sell the Property pursuant 'Ito
Pennsylvania law.
9. Notice of Intention to Foreclose and a Notice of Homeowners' Emergency Mortgage Assistance has
been sent to Defendant by certified and regular mail, as required by Act 160 of 1998 of the
Commonwealth of Pennsylvania, on the date(s) set forth in the true and correct copy of such notice(s)
attached hereto as Exhibit "B". The Defendant have not had the required face-to-face meeting within
the required time and Plaintiff has no knowledge of any such meeting being requested by the Defendant
through the Plaintiff, the Pennsylvania Housing Finance Agency, or any appropriate Consumer Credit
Counseling Agency.
WHEREFORE, Plaintiff demands a de terris judgment in mortgage foreclosure in the sum of $301,759.59,
together with interest at the rate of $46.87, per day and other expenses, costs and charges incurred by the
Plaintiff which are properly chargeable in accordance with the terms of the Mortgage and Pennsylvania law
until the Mortgage is paid in full, and for the foreclosure of the Mortgage and Sheriff's Sale of the Property.

assist you in submitting a complete application to the Pennsylvania Housing Finance
Agency. Your application MUST be filed or postmarked within thirty (30) days of your

YOU MUST FILE YOUR APPLICATION PROMPTLY. IF YOU FAIL TO DO SO OR IF
YOU DO NOT FOLLOW THE OTHER TIME PERIODS SET FORTH IN THIS LETTER,
FORECLOSURE MAY PROCEED AGAINST YOUR HOME IMMEDIATELY AND
YOUR APPLICATION FOR MORTGAGE ASSISTANCE WILL BE DENIED.
AGENCY ACTION - Available funds for emergency mortgage assistance are very
limited. They will be disbursed by the Agency under the eligibility criteria established by
the Act.
The Pennsylvania Housing Finance Agency has sixty (60) days to make a decision after it
receives your application. During that time, no foreclosure proceedings will be pursued
against you if you have met the time requirements set forth above. You will be notified
directly by the Pennsylvania Housing Finance Agency of its decision on your application.
NOTE: IF YOU ARE CURRENTLY PROTECTED BY THE FILING OF A PETITION IN
BANKRUPTCY, THE FOLLOWING PART OF THIS NOTICE IS FOR INFORMATION
PURPOSES ONLY AND SHOULD NOT BE CONSIDERED AS AN ATTEMPT TO
COLLECT THE DEBT.
(if you have filed bankruptcy, you can still apply for Emergency Mortgage Assistance.)
IF YOU DO NOT CURE THE DEFAULT(see page 11- If you do not cure the default
within THIRTY (30) DAYS of the date of this Notice, the lender intends to exercise its
rights to accelerate the mortgage debt This means that the entire outstanding balance
of this debt will be considered due immediately and you may lose the chance to pay the
mortgage in monthly installments. If full payment of the total amount past due is not made
within THIRTY (30) DAYS, the lender also intends to instruct its attorneys to start legal
action to foreclose upon your mortgage property.
IF THE MORTGAGE IS FORECLOSED UPON - The mortgaged property will be sold by
the Sheriff to pay off the mortgage debt. If the lender refers your case to its attorneys, but
you cure the delinquency before the lender begins legal proceedings against you, you will
still be required to pay the reasonable attorney's fees that were actually incurred, up to
$50.00. However, if legal proceedings are started against you, you will have to pay all
reasonable attorneys' fees actually incurred by the lender even if they exceed $50.00. Any
attorney's fees will be added to the amount you owe the lender, which may also include
other reasonable costs. If you cure the default within the THIRTY (30) DAY period
you will not be required to pay attorney's fees.
OTHER LENDER REMEDIES - The lender may also sue you personally for the unpaid
principal balance and all other sums due under the mortgage.
RIGHT TO CURE THE DEFAULT PRIOR TO SHERIFF'S SALE - If you have not cured
the default within the THIRTY (30) DAY period and foreclosure proceedings have begun,
you still have the right to cure the default and prevent the sale at any time up to one hour
before the Sheriffs Sale. You may do so U plying the total amount then past due plus any
late or other charges then due reasonable attomey's fees and costs connected with the
foreclosure sale and any other costs connected with the Sheriffs Sale as specified in
writing by the lender and by performing any other requirements under the mortgage. Cur-
ing your default in the manner set forth in this notice will restore your mortgage to
the same position as if you had never defaulted.
EARLIEST POSSIBLE SHERIFF'S SALE DATE - It is estimated that the earliest date

Plaintiff, by and through its attorney, in support of its Motion for Substituted Service,
represents as follows:
Plaintiff is the holder of a first mortgage upon the premises Lot 70, 890 Sawgrass Drive,
Mechanicsburg, PA, 17050, hereinafter, the "mortgaged premises".
2. Defendant, GARY L. CHRONISTER, is the mortgagor and real owner of the mortgaged
premises.
3. Pursuant to Cumberland County Local Rule 208.3(a)(2) and/or Rule 208.3(a)(9), I, David
Fein, Esquire, hereby certify that no judge has ruled on any other matters in this case. I further certify
that I am not aware that the Defendant has obtained counsel. Moreover, due to the nature of this motion,

it was not possible to locate or contact the Defendant to request his concurrence.
4. The last known address of Defendant, Gary L. Chronister, is 4989 Amelias Path East,

5. The Sheriff has been unable to effect service of the Complaint upon Defendant, Gary L.
Chronister, at the property, Lot 70, 890 Sawgrass Drive, Mechanicsburg, PA, 17050. Per Sheriff, the
property is vacant. Service was also attempted at the last known address, 4989 Amelias Path East,
Mechanicsburg, PA, 17050. Per Sheriff, there was no service made, after numerous attempts.
6. The following investigation was conducted in a good faith attempt to ascertain the
whereabouts of Defendant, Gary L. Chronister.
WHEREFORE, Plaintiff prays that the Court enter the attached order allowing Plaintiff

Plaintiff has filed a Complaint in Mortgage Foreclosure against Defendant, Gary L.
Chronister, which the Sheriff has been unable to personally serve upon Defendant, Gary L. Chronister.
As noted in the attached Motion, Plaintiff has made a good faith attempt to ascertain Defendant's
whereabouts without success. Accordingly, the Court may approve alternative means of service. See
Pa.R.C.P. 430(a).
CONCLUSION

RECITAL: Being the same premises which Jimjam, LLP, James E. Grandon, Jr. and
Jean Grandon, by their deed dated May 14, 2002 and recorded June 20, 2002 in
the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania
in Deed Book 252, Page 1355, granted and conveyed unto Gary L. Chronister and
Jean E. Chronister, husband and wife.
The Premises identified above and as more fully described in the legal description
attached hereto and incorporated by reference herein as "Exhibit A" is subject to the below items
and exceptions. All recording and docket locations identified are in the Office of the Recorder of
Deeds of Cumberland County and/or the Court of Common Pleas of Cumberland County.
EXCEPTIONS:
1. Claims and charges for improvements and repairs to the Premises or delivery of materials
thereto for which payment has not been made.
2. Possible unfiled Mechanics Liens and municipal claims, charges and assessments.
3. The rights or claims of any tenants or other parties in possession.
4. Support arrearages of any owner or previous owner of the Premises pursuant to Act 58 of
1997, as amended.
Any environmental liens or claims filed or on record in the Federal District Court.
6. Payment of state and local real estate transfer tax, if applicable.
7. Any secured transactions with respectaq the Premises.
8. The area of the Premises is not certified.
9. Those matters which a view or inspection of the Premises would reveal.
10. The accuracy of the measurements and dimensions of the Premises or the rights or title of
or through any person or persons in possession of same, conflicts with adjoining
property, encroachments, projections or any other matter disclosed by an accurate survey
of the Premises.
11. The right of use as may be determined by any applicable municipal zoning ordinance or
regulation.
12. Any matter not of record at the Court House as of the effective date of this Title Report
and subsequent to the date hereof.
13. Any tax increase based on additional assessment made by reason of new construction or
major improvements.
14. The absence or failure of proper and required notice being given to all owners and
holders of liens and encumbrances intended to be divested by the Sheriffs sale and
procedural defects by any judgment creditor or lienholder executing on the Premises
giving rise to the Sheriffs sale noted above.
15. Identity and legal competency of all parties at any closing or conveyance of the Premises
should be established.
16. Access to the Premises by public road or street is not certified.
17. Suitability or existence of sewer and water facilities on or available to the Premises is not
certified.
18. Real Estate taxes on the Premises due and payable but not turned over for collection to
the Tax Claim Bureau.
19. All Real Estate taxes on the Premises assessed but not billed as well as those Real Estate
taxes accruing on and after January 1, 2009.
20. Mortgage in the amount of $300,700.00 from Gary L. Chronister and Jean E. Chronister
to National City Mortgage Co. dated June 17, 2002 and recorded June 20, 2002, in
Mortgage Book 1762, Page 2580.
21. Mortgage in the amount of $334,204.00 from Gary L. Chronister to Farmers and
Merchants Trust Company of Chambersburg dated February 14, 2008 and recorded
February 28, 2008 to Instrument No. 200805784, amended by Correctory Mortgage dated
October 22, 2008 and recorded October 29, 2008 to Instrument No. 200835447 for
purposes of attempting to correct the date of the Mortgage.
22. Judgment against Gary L. Chronister b) the amount of $314,564.58 in favor of National
City Mortgage, Inc. entered January 21, 2009 to No. 2008-4648 with respect to the
mortgage identified as item 20, above.
23. Judgment against Gary Chronister and Patriotic Venture, Inc. in favor of Bureau of
