Plaintiff, First National Bank of Omaha, by its undersigned attorney and pursuant
to Pa. R.C.P. 430(a) moves this Court for a special order permitting service of the
Complaint in this action by regular and certified mail to the last known address of
defendant. In support of this motion, Plaintiff avers the following:
1. The last known address of the Defendant is Post Office Box 645,
Shippensburg, PA 17257-0645.
2. The instant action concerns Defendant's default on a credit card contract
for which Defendant failed to pay Plaintiff the balance due.
3. The last know physical address of Defendant is 412 South Penn Street,
Shippensburg, PA 17257. A true and correct copy of the Freedom of Information
Request is attached hereto marked Exhibit "A" and incorporated herein by reference.
4. On numerous occasions the Sheriff of Cumberland County attempted
service at the 412 South Penn Street, Shippensburgi, PA address, but advised it is

vacant. A copy of the Sheriffs Return is attached hereto, marked Exhibit "B" and
incorporated herein by reference.
5. A Federal Freedom of Information Act Request to the Shippensburg Post
office was returned with information that Defendant are receiving mail at the post office
address named herein (a copy of the F.O.I.A. is attached as Exhibit "A").
6. To the best of Plaintiffs knowledge, information and belief, the post office
address named herein is the only known address of Defendant.
7. Plaintiff has made a good faith effort to locate and serve Defendant, but
has been unsuccessful.
8. Plaintiff believes that Defendant is intentionally avoiding service of
process in this matter.
9. Unless this Court allows service by way of mail to Defendant's last known
address, Plaintiff will be unable to maintain this action and injustice will result.
WHEREFORE, the Plaintiff requests this Court enter an Order Directing Service
of the Complaint on Defendant by certified and regular mail at the post office address.

I, Jeffrey S. Wilson, Esquire being duly sworn according to law, deposes and
says the following:
1. 1 am the Plaintiffs Attorney in the above captioned action.
2. At my direction, the Sheriff of Cumberland County attempted service on
the Defendant. The results of which are attached to Plaintiffs Motion for Special Order
Directing Service by Certified and Regular Mail as Exhibit "B".
3. At my direction, Federal Freedom of Information Requests were sent to
the Shippensburg Post Office. The result of which is attached to Plaintiffs Motion for
Special Order Directing Service by Certified and Regular Mail as Exhibit "A".
4. 1 have been unable to locate any address for Defendant except P.O. Box
645, Shippensburg, PA 17257-0645.
5. As set forth in the attached return of no service, efforts to serve the
Defendant have not been successful.
6. The stated post office address is Defendant's only address to the
best of my personal knowledge, information and belief.
7. The allegations in the foregoing Motion for Special Order Directing Service
by Certified and Regular Mail, the attached exhibits are true and correct to the best of
my personal knowledge, information and belief.

1. Plaintiff, with the principal address and name as above, is hereinafter
referred to as Plaintiff.
2. Defendant, with principal address and name as above is an individual residing
at the above address, hereinafter referred to as Defendant.
3. Defendant purchased goods and services on an account, pursuant to credit
card agreements with Visa/Mastercard, a true and correct copy of which is attached
hereto as Exhibit "A" and incorporated herein by reference as if set forth at length.
4. Books of account have been maintained, keeping an accurate and running
account of all debits and credits for the sale of goods and services received by
Defendant and periodically submitted same to Defendant for payment. True and correct
copies of said statements are available upon request, but are too voluminous to be
attached hereto. Instead, a statement for each account is attached hereto as Exhibit "B"
and incorporated herein by reference as if set forth at length.
5. Defendant received and accepted the aforesaid goods and or services.
6. The prices set forth in the statement were the market prices and are
reasonable and the prices Defendant agreed to pay.
7. All credits due, if any, to Defendant have been applied to Defendant's
account.
8. Defendant received the written account, made no objection, but agreed with
Plaintiff that the account is true and correct and that the Defendant owes Plaintiff,
THREE THOUSAND NINE HUNDRED EIGHTY-FIVE DOLLARS AND NINETY-THREE
CENTS ($3,985.93) the sum set forth as due on the account.
9. In accordance with the written contract, there is interest due from the date of
attached to the date of this suit in the sum of THREE HUNDRED EIGHTEEEN
DOLLARS AND FORTY-EIGHT CENTS ($318.48).
10. Although demand of the sum justly due Plaintiff has been frequently made,
Defendant neglected, failed and refused to make payment thereof.
WHEREFORE, Plaintiff demands Judgment against Defendant in the sum of
FOUR THOUSAND THREE HUNDRED FOUR DOLLARS AND FORTY-ONE CENTS
($4,304.41) plus interest and costs.
