STIPIILATION
THIS AGREE[~NT made this
and between

day of 2008, by
McCoy BROS., INC., hereinafter referred to as Contractor,
AND
Big Spring IInited Lutheran Church, hereinafter referred to as
Owner, whereby the contractor undertook and agreed to erected and
construct a church situate in West Pennsboro Township, Cumberland
County, Commonwealth of Pennsylvania, and more fully described in
Exhibit "A" which is attached hereto and made a part hereof known
as 101 Crossroad School Road, Newville, PA 17241.
NOW THEREFORE, THIS AGREEI~NT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar
to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its,
his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims
shall be filed or maintained by them or any of them against the
said buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under
them, hereby expressly waive and relinquish the right to have,
file, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

Richard L. Butts who acknowledged himself to be the Vice
President of Estimating of McCoy Bros., Inc., and that he as such
Vice President of Estimating, being authorized to do so, executed
the foregoing instrument for the purposes therein contained by
signing the name of the said Corporation by himself as such Vice
President of Estimating.

ALL that certain lot of land situate in West Pennsboro Township, Cumberland County,
Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a P.K. nail within the center of the intersection of Newville Road, S.R.
0641, and Crossroad School Road, T-438, and being the northwestern corner of Lot herein
conveyed as shown on the hereinafter mentioned Subdivision Plan; thence along Newville
Road, SR 0641, North 57 degrees 25 minutes Ol seconds East a distance of 820.05 feet to a
P.K. nail on the property line of other lands now or formerly of Walter M. and Virginia J.
Fickes; thence along other lands of Walter M. and Virginia J. Fickes South 47 degrees 46
minutes 44 seconds East a distance of 1362.75 feet to an iron pin on the property line of
lands now or formerly of Kenneth Dale and Rhonda Lee Ankabrandt; thence along lands of
Kenneth Dale and Rhonda Lee Ankabrandt South 39 degrees 34 minutes 36 seconds West, a
distance of 702.90 feet to a railroad spike on the centerline of Crossroad School- Road
passing through an iron pin 25.36 feet from end point; thence along the centerline of
Crossroad School Road, T-438, North 51 degrees 09 minutes 40 seconds West, a distance of
633.34 feet to a railroad spike at the dividing line of Lot 24 and lands now or formerly of
David P. and Sally A. Wagner; thence continuing along said Crossroad School Road, T-438,
North 50 degrees, 48 minutes 53 seconds West, a distance of 979.25 feet to a P:K. nail within
the center of the intersection of Newville Road, S.R. 0641, and Crossroad School Road, T-
438, the place of BEGINNING.
CONTAINING a total area of 25.43200 acres and being Lot 25 on a Land Subdivision for
Stonecrest Acres recorded in Cumberland County Plan Book 81, Page 124.
