Home My WebLink About08-07-08FAMILY SETTLEMET AND FINAL RELEASE IN ESTATE OF OLIVE MAY BEAM, DECESASED KNOW ALL PERSONS BY THESE PRESENTS, that WHEREAS, Olive May Beam, of Camp Hill, Cumberland County, Pennsylvania, deceased, died testate on August 18, 2006, having made her last will and testament, which was duly executed on February 2, 2005and is duly recorded in the Cumberland County Will Book; WHEREAS, the said late Olive May Beam, by the aforesaid last will and testament, named Maureen O. Hench Executrix of said last will and testament; WHEREAS, letters testamentary on the estate of said decedent were duly issued by the Register of Wills of Cumberland County, Pennsylvania to the said Executrix, hereinafter called "personal representative;" WHEREAS, the said personal representative has gathered the assets of the estate of the said decedent and the assets consisted of both personal and real property, to a total W~tc1 ~.A% 7o,aµ, ~ value of 1 d9 ~3s~ , as set forth in Exhibit A, which is an informal statement of account of the said personal representative in the form of the checkbook register of the estate checking account, and which is attached hereto and made part hereof, and marked ~.. WHEREAS, the balance for distribution as shown in the said statement marked as Exhibit A has been reduced to cash and will be distributed as indicated herein in accordance with the last will and testament of the said decedent; NOW, THEREFORE, KNOW YE, that we Wendy Clouser, Linda Tardio, and Maureen Hench, being all of the children of the said decedent and all of the heirs under the last will and testament of the said decedent, and being all the persons entitled to inherit under the said last will and testament, do hereby, each of us, acknowledge, that we have this day had and received from the aforesaid personal representative, in full satisfaction and payment of all sum or sums of money, legacies, bequests, and devises as are given, devised and bequeathed to each of us respectively by the said last will and testament, the amount due us under said last will and testament, which amounts we have received this day or will receive this day and which amounts are set forth herein. AND, each of us does hereby stipulate that in order to avoid the expense and time involved in the filing of a formal; account and schedule of distribution, we each agree that no account is necessary and we do hereby agree that we do consent to distribution being made without the filing of an account and the schedule of distribution, the same to be with the same force and effect as if they had been filed and confirmed by the Orphan's Court Division of the Cumberland County Court of Common Pleas. We also acknowledge that in the event that an over payment of estate taxes has been reserved or made, the personal representative will distribute the funds in accordance in the last will and testament of the decedent as soon as practible, THEREFORE, we and each of do hereby remise, release, quitclaim, and forever discharge the said personal representative, Maureen O. Hench, her heirs, executors, and administrations and assigns, of and from the said estate and from all actions, suits, payments, reckonings, claims and demands for any reason thereof, or for any other use, matter, cause or thing whatsoever touching upon the estate of the said decedent, and each of us do further hereby covenant and agree that should any liability come due to the estate of the said decedent after signing this agreement, we and each of us do hereby covenant and agree with each other and the aforesaid personal representative that we will contribute pro rata our share of the estate to satisfy any and all claims, demands, suits, or causes of actions which may be successfully prosecuted against the said estate of the decedent or the personal representative after the signing, sealing and delivery of this family settlement agreement and final release.
