FINAL ORDER
AND NOW, to wit this the day , 2008, it is hereby
ordered that the settlement in the amount of Fifty Thousand ($50,000.00} Dollars is
granted. The proceeds are to be distributed as follows:
(a) The net wrongful death proceeds of $18,750.00 will be placed in a federally
insured bank or saving institution as permitted by the Rules of Civil Procedure
for benefit of the minor children, to be divided equally into accounts for each
of the minor children. Said account to be endorsed to prohibit withdrawal of
the monies therein until the child is eighteen or further order of court issues.
(b} The net survival action monies of $18,750.00 will be made part of the Estate
of Steve Dollins and distributed in accord with the accounting thereof to be
produced when the estate is closed.
(c} An amount of $12,500.00 of the proceeds will be paid to Rominger and
Associates, pursuant to the fee agreement executed by the estate.
(d) All sums set forth above constitute damages on account of personal
injurylwrongful death, arising from the occurrence, within the meaning of §
104 (a) (2) of the Internal Revenue Code of 1986, as amended.
(e) Further, nothing in this approval is meant to be construed as a limitation on
any other cause of action available, andlor as to any party, including any UIM
/ UM policies.
