Plaintiff is Triple C Wholesalers, Inc., a Maryland Corporation, with an office and place of business at 2801 W. Patapsco Avenue, Baltimore, Baltimore County, Maryland 21230. 2. The Defendants are Bruce M. Horowitz and Chong H. Horowitz, adult individuals, t/a Youngs Deli with an office and place of business at 672 Bloserville Road, Newville, Cumberland County, Pennsylvania 17241 and a residence at 75 Chester Street, Carlisle, Cumberland County, Pennsylvania, 17013. 4. This action is based on an instrument (Customer Credit Application and Security Agreement) dated September 22, 2006 between Plaintiff and Defendants and the terms and conditions contained therein authorizing confession of judgment, of which a true and correct copy is attached hereto and made a part hereof, marked Exhibit A. 4. Judgment for money damages has not been entered on the Agreement in any jurisdiction. 5. Judgment is not being entered by confession against natural persons in connection with a consumer credit transaction. 6. Judgment may now be entered on the Agreement because of the occurrence of the following defaults and/or fulfillment of the following conditions precedent: (a) Under the Agreement, Defendants are obligated to pay Plaintiffs invoices upon receipt of merchandise. (b) Defendants have failed to make payments to which it is obligated under the Agreement in the total amount of $4,372.96 and remains open for business. (c) Accordingly, Defendants are in default of its obligation under the Agreement. (d) By virtue of Defendants' default under the Agreement, Plaintiff is entitled to confess judgment against Defendants for past due unpaid invoice(s) in the amount of $4,372.96, together with attorney's fees, and costs. 7. The amount now due is as follows: Prior unpaid balance of invoices Attorney fees as authorized in the Agreement Total Amount Now Due -- $4,372.96 -- 655.94 -- $5,028.90 8. Interest on the judgment, and all costs and charges collectible under the Agreement which accrue hereafter, are to be collectible under the judgment. WHEREFORE, Plaintiff demands that Judgment be entered in its favor and against the Defendants for $5,028.90 the total amount due, as set forth in Paragraph No. 7, above, together with costs as allowed by law.
