The PLAINTIFF is ABEC GROUP, LLC, a limited liability company organized and existing under the laws of the Commonwealth of Pennsylvania, with its principal place of business at 918 Mechanic Street, Lebanon, Lebanon County, Pennsylvania 17042 and hereinafter sometimes referred to as "Plaintiff'. 2. The DEFENDANT is BINK PARTNERSHIP INC., a corporation organized and existing under the laws of the Commonwealth of Pennsylvania, trading and doing business as BINK ARCHITECTURAL PARTNERSHIP with its principal place of business at 133 South 32nd Street, Camp Hill, Cumberland County, Pennsylvania 17011 and hereinafter sometimes referred to as "Defendant". 3. In 2005 the authorized agents, representatives, servants and employees of the Camp Hill Presbyterian Church retained the Plaintiff to perform the following work and to render the following services in connection with proposed erection and construction of the Camp Hill Presbyterian Church located in Camp Hill, Cumberland County, Pennsylvania: Prepare Electrical Deskn/Build documents for the renovation and upgrading of the stated proiect in compliance with the IBC code requirements as mandated by the governing authorities. Amend documents in accordance with the review comments. Seal final set for submission to governing authority, 4. The normal per hour rates which Plaintiff normally charged for the services described in Averment 3 are $100.00 an hour for engineering services and $65.00 an hour for design services which the Camp Hill Presbyterian Church agreed to pay. 5. Subsequent to the Camp Hill Presbyterian Church retaining Plaintiff to perform the services described in Averment 3 and subsequent to Plaintiff beginning to render the services described in Averment 3, the Camp Hill Presbyterian Church requested that the Plaintiff send the invoice for services directly to the Defendant for the services to be rendered by the Plaintiff described in Averment 3 hereof based on the rates set forth in Averment 4 hereof; and the Defendant's authorized agents, representatives, employees and servants agreed to be responsible to pay the Plaintiff for the services to be rendered as described in Averment 3 hereof at the rates set forth in Averment 4 hereof. 6. Based on the rates set forth in Averment 4 hereof, the Plaintiff performed 144 hours of engineering services at $100.00 an hour for a total of $14,400.00 and 67 hours of design services at $65.00 an hour for a total of $4,355.00 with the combined total for engineering services and design services being $18,755.00. 7. On January 31, 2008, Plaintiff sent to Defendant an Invoice for the services rendered by Plaintiff described in Averment 3 hereof at the rates set forth in Averment 4 hereof with an amount of the Invoice being $18,755.00, a copy of said Invoice dated January 31, 2008 is attached hereto, marked Exhibit "A" and incorporated herein by reference thereto. 8. Defendant refused to pay the sum of $18,755.00 and Defendant's authorized agents, representatives, employees and servants required Defendant to change the manner by which Plaintiff was to bill Defendant for the services described in Averment 3 hereof which Plaintiff had in fact rendered to Defendant before Defendant would pay Plaintiff. 9. Consequently, the authorized agent, representative, employee and servant of Defendant, being Stew Cluck, Defendant's project architect, and Plaintiff agreed that the Plaintiff would charge 5% of the amount of the original estimate dated May 8, 2006 for electrical construction work to be performed in the proposed erection and construction of Camp Hill Presbyterian Church located in Camp Hill, Cumberland County, Pennsylvania for the services described in the Invoice (Exhibit "A") and Defendant's authorized agent, representative, employee and servant agreed to pay that amount. 10 The May 8, 2006 estimate for the electrical work to be performed in the proposed erection and construction of Camp Hill Presbyterian Church located in Camp Hill, Cumberland County, Pennsylvania was $265,500.00 of which 5% was $13,275.00. 1 I . Consistent with the agreement for compensation set forth in Averments 9 and 10 hereof, on June 2, 2008, Plaintiff forwarded to Defendant a revised Invoice for $13,275.00 (Exhibit "A"). 12. Despite repeated demands upon the Defendant by Plaintiff, Defendant has not paid the Invoice (Exhibit "A"), Defendant has not paid Plaintiff the sum of $13,275.00. 13. The services rendered by Plaintiff to Defendant were performed timely and were of a high professional quality. 14. At no time did the Defendant ever object to the quality and timing of the work and services performed by the Plaintiff for the Defendant. 15. In addition to the sum of $13,275.00, Plaintiff is entitled to interest on the sum of $13,275.00 at the annual rate of 18% effective 30 days after the date of the Invoice (Exhibit "A") to wit; March 3, 2008, being $6.52 per day. 16. As of July 21, 2008 Plaintiff is entitled to interest of $913.07. WHEREFORE, the PLAINTIFF, ABEC GROUP, LLC, prays your Honorable Court for a judgment in favor of the PLAINTIFF, ABEC GROUP, LLC, and against the DEFENDANT, BINK PARTNERSHIP INC. T/DB/A BINK ARCHITECTURAL PARTNERSHIP, for the sum of $14,13 8.07, plus interest at the rate of $6.52 from the date of this Complaint, along with costs of suit. You shall pay The Phillips Group the billing upon invoice receipt If any payment is made more than ten (10) days late, you will pay a penalty of 10% of payment or $22.00, whichever is greater, on the past due amount. You will pay $50.00 for each check that is returned for insufficient funds or for any other reason. 6. MAINTENANCE AND SUPPLIES: The charges established by this Agreement include payment for the use of the Equipment and accessories, maintenance (during normal business hours); inspection, adjustment. parts replacement, drums and cleaning material required for the proper operation, as well as inks, toner and developer. You must separately purchase paper products (paper & masters), staples and waste toner collector bottles. At our discretion, services and supply may be provided by a third party selected by us, should service and supplies be required outside our authorized dealer territories. In reference to our Service Response Commitment 'copier inoperable' is defined as anytime a system is unable to produce a legible document It is understood that you will provide basic user maintenance and trouble shooting such as, misfeed removal, toner and paper replenishment, etc. 7.GOLD LEVEL PROFESSIONAL SERVICE SUPPORT: All connected systems (printing, scanning, faxing, copying) will include 90 days of support for the following services: Installation of software and print drivers on either the client's server or on the individual workstations in a peerdo-peer environment. We will install such software and drivers during the initial installation on up to twenty (20) workstations per connected system at no additional charge. Support for Network Administrator on installing Printer / software to Server / Network / Instructions on Web-based utilities and configuration of Printer / Software / Support for scanning / SHARPdesk or Page Scope scanning utility setup for up to 5 workstations per connected device / Establish device as 'default' printer / Technical phone support / Supply patch cable / Network Surge protector. Each workstation in excess of 20 or future network services provided by us will be invoiced at a rate of $125.00 per hour. The minimum billable amount is $82.50 (1/2 hour). In an effort to accommodate customers with a large client base, we recommend you make an IT staff member available on-site during our initial installation. We will provide resources (print drivers & technical bulletins) necessary for additional installations by your IT staff. Our 90-day system performance commitment applies to your network operating system, desktop environment, application software and architecture functioning at the time of initial installation. Additional Professional Support Services may be acquired at a discounted rate by investing in one of our PLATINUM level Support Options. 8. TITLE: We are the owner of the Equipment and during the length of our agreement you shall keep the Equipment free and clear of all claims and liens.
