COMPLAINT IN CIVIL ACTION
AND NOW, comes Plaintiff, CAPITAL ONE BANK USA NA, by and through its
attorney, Paul J. Klemm and the law offices of Nudelman, Nudelman & Ziering, P.C., and files
the following Complaint in Civil Action and in support thereof aver as follows:
1. Plaintiff, CAPITAL ONE BANK USA NA, is a corporation licensed to do
business in the State of Pennsylvania.
2. Defendant, MARY K KNOLL, is an individual and citizen of the Commonwealth
of Pennsylvania, who is believed to currently reside at, 934 WERTZVILLE RD, ENOLA PA
17025-1835.
3. At the special insistence and request of the Defendant, Defendant was issued a
credit card by CAPITAL ONE BANK USA NA, account number 4862362534943132.
4. The Defendant is responsible for an unpaid balance in the amount of $6,082.44
and interest in the amount of $844.35.
5. Plaintiff has made demand to Defendant for $6,926.79, but Defendant has
willfully failed and/or refused to reimburse Plaintiff for the aforesaid sum due.
Wherefore, Plaintiff demands Judgment in its favor and against the Defendant in the
amount of $6,926.79, plus attorney fees of $1,338.14 and interest from the date of breach, with
continuing interest thereon at the legal rate from the date of Judgment plus anticipated court
costs. The damages requested are less than the maximum amount for compulsory arbitration as
set by the Court.

ANSWER TO COMPLAINT
I, Mary Kay Knoll, the defendant in Case #084774, hereby state that I owe
the plaintiff, Capital One Bank the amount of $6,082.44. I have been unable
to pay due to a financial hardship. My spouse lost his job with a sizeable
income so I had to work two jobs in order to pay everyday expenses and still
got behind on my credit card bills. With all the added fees and high finance
charges I could no longer make even the minimum payments. At that time I
contacted Debt Settlement America to help me negotiate a settlement with
my creditors. They are currently in contact with Nudelman, Nudelman &
Ziering and I hope that they will reach an agreement soon.

AMENDED ANSWER TO COMPLAINT WITH NEW MATTER
The Defendant, Mary K. Knoll, files this Amended Answer
to Plaintiff's Complaint With New Matter, averring as follows:
AMENDED ANSWER
1. Defendant is without sufficient information,
knowledge and/or belief to respond.
2. Admitted.
3. It is admitted that Defendant responded to a
solicitation from Plaintiff to get a credit card.
4. Denied as Plaintiff has not attached any statements
regarding the credit card, nor any contract indicating what, if
any, interest can be charged.
5. It is admitted only that Plaintiff has tried to get
Defendant to pay monies. The remainder of the allegation is
denied.
WHEREFORE, Defendants respectfully request that
Plaintiff's Complaint be dismissed with prejudice.

NEW MATTER
6. Defendant hereby incorporates paragraphs 1 through
5 above as if fully set forth herein.
AFFIRMATIVE DEFENSES
7. Plaintiff's Complaint fails to state a claim upon
which relief can be granted.
8. Plaintiff's claims are barred by the doctrines of
waiver, estoppel and/or laches.
9. Plaintiff's claims are barred by the 4 year statute
of limitations on consumer debts.
10. The damages alleged by Plaintiff are inaccurate and
unlawful and not owed by the Defendant.
11. Plaintiff suffered no ascertainable loss of money or
property as the alleged debt was purchased in default, along with
possibly thousands of other alleged debts, for a nominal amount by
Plaintiff.
12. The Plaintiff has no standing to bring this action.
The Verification was signed by the attorney. It is unclear as to
the true identity of the Plaintiff.
13. The Plaintiff is not entitled to fees, costs,
interest, etc. as there is no contract between Plaintiff and
Defendant.
14. Defendant disputes the amounts alleged by Plaintiff
to be owed.
15. As Plaintiff has not attached any contract to its
Complaint or evidence of a debt owed, Defendant cannot be certain
as to any further affirmative defenses she may have or the claims
she may have against Plaintiff arising from its collection
practices. Defendant reserves the right to assert additional
affirmative defenses as discovery warrants, particularly with
regard to the harassment she has suffered via plaintiff's unlawful
collection techniques.
WHEREFORE, Defendant respectfully request that
Plaintiff's Complaint be dismissed with prejudice.
