Plaintiff is a corporation having offices at 101 East Carmel Drive Ste 205, IN,46032. 2. Defendant is an individual whose address is 2 Irish Gap Road Newville , Cumberland County, Pennsylvania 17241-9514. 3. On or about October 15, 2004, the Defendant applied for and was granted a revolving open end charge account or loan by Plaintiff to purchase a water treatment system at the terms and conditions agreed upon by the parties, as is more specifically shown by the Application, Agreement, and delivery receipt, true and correct copies of which is attached hereto, marked Exhibit "A" and made a part hereof. 4. The Plaintiff avers that the agreement between the parties was based upon a written agreement which the Defendant accepted by using said credit or loan to make purchases and/or cash advances. 5. Thereafter, in breach of obligations under the Agreement, the Defendant failed to make payments as they became due. 6. Plaintiff avers that the terms of the Agreement provide for acceleration of the entire balance due and owing upon Defendant's breach of the Agreement. 7. Plaintiff avers that the balance due of principal and interest amounts to $6,039.52, as is more specifically shown by Plaintiff's Statement of Account, a true and correct copy of which is attached hereto, marked Exhibit "B" and made a part hereof. 3 8. Plaintiff avers that the interest has accrued at the rate of 17.90% per annum on the principal balance due of $3,602.94 from November 15, 2004. 9. Plaintiff avers that the parties agreement provided that Defendant will pay a late fee of $15.50 on each over due payment. Since no payments were made, that amount is due for each month beginning with November, 2004. 10. Per the term of the agreement, the Defendant has agreed to pay to the Plaintiff as liquidated damages, the costs of collection, including all reasonable attorneys' fees incurred in the collection of monies owing, which Plaintiff avers will amount to 25% of the balance due. 11. Although repeatedly requested to do so by Plaintiff, Defendant has willfully failed and refused to pay the amount due to Plaintiff or any part thereof. WHEREFORE, Plaintiff demands Judgment against Defendant(s) in the amount of $6,252.77, with appropriate additional interest from November 15, 2004, plus attorneys fees and costs.
