C,_?Pkq PETITION FOR APPOINTMENT OF HUMANE SOCIETY POLICE OFFICER To the Honorable Court: The Pennsylvania SPCA, by its attorney Daniel E. Mueller, hereby moves this Court for an Order approving JACK ARDREY, JR. as a humane society police office and respectfully represents in support thereof as follows: 1. The Pennsylvania SPCA is a nonprofit corporation organized and existing under the laws of the Commonwealth of Pennsylvania for the purpose of preventing cruelty to animals. Its principal office and place of business is located at 350 E. Erie Avenue, Philadelphia PA 19134. 2. JACK ARDREY, JR., an adult individual, residing at 425 Sheridan Street, Williamsport, PA 17701 has been employed by the Pennsylvania SPCA as an anti-cruelty investigator since May 25, 2008 and was appointed a Humane Society Police Office on June 11, 2008 by the Court of Common Pleas of Philadelphia County in accordance with the provisions of the Humane Society Police Officer Enforcement Act, Act 135 of 1994 Sessions, effective February 10, 1995. 3. This Petition is filed pursuant to Act of November 30, 2004, P.L. 1603, No. 205, entitled "Humane Society Police Officers, Powers and Duties of the Department of Agriculture and Establishment of Humane Society Police Officer Advisory Board", approved November 30, 1994 and effective May 30, 2005 (hereinafter referred to as "Act"). A true and correct copy of the Act is attached hereof and marked Exhibit "A". 4. This Court has jurisdiction and authority under Section 3704(a) of the Act to appoint JACK ARDREY, JR. as a Humane Society Police Officer with authority to act in CUMBERLAND COUNTY upon evidence that the said JACK ARDREY, JR. has satisfied the requirements of Section 3705 of the Act. 5. Evidence of compliance with the requirements of Section 3705 of the Act is furnished as follows: a) JACK ARDREY, JR. has been a resident of the Commonwealth of Pennsylvania for the twelve (12) months previous to the date hereof. b) JACK ARDREY, JR. has successfully completed the training program established pursuant to Section 3712 of the Act as evidenced by certificates of satisfactory completion of such training attached hereto as Exhibits "B" and "C"; C) JACK ARDREY, JR. has obtained a criminal history report, a copy of which is attached hereto as Exhibit "D"; d) JACK ARDREY, JR. has not been convicted of a felony or serious misdemeanor, as shown by the criminal history report attached as Exhibit "D"; e) JACK ARDREY, JR. has not been convicted of any offense, including summary offense, related to cruelty to animals as shown by Exhibit "D"; f) JACK ARDREY, JR. has not been convicted in any other jurisdiction of an offense equivalent to an offense graded a felony, a serious misdemeanor or an offense of cruelty to animals. 6. The said JACK ARDREY, JR. is directed by his employer, The Pennsylvania SPCA to CUMBERLAND COUNTY. 7. The said JACK ARDREY, JR. has met in all respects the requirements of the Act for appointment as a Humane Society Police Officer under Act with authority to act in CUMBERLAND COUNTY. WHEREFORE, your petitioner, the Pennsylvania SPCA, respectfully requests that this Honorable Court fix a date for hearing for review of the qualifications of JACK ARDREY, JR. for appointment as a Humane Society Police Officer in CUMBERLAND COUNTY or, in the alternative, that it enter an Order appointing the said JACK ARDREY, JR. as a Humane Society Police Officer for The Pennsylvania SPCA in accordance with the Act of November 30, 2004, P.L. 1603, No. 205, effective May 30, 2005.
