1. The Plaintiffis Neil R. McCoy, an adult individual residing at 110 N. Middlesex
Road, Carlisle, Cumberland County, Pennsylvania, 17013.
2. The Defendant is Cristina M. McCoy, an adult individual residing at 152 Fairview
Street, Carlisle, Cumberland County, Pennsylvania, 17055.
3. Plaintiff seeks custody of the following children:

The mother of the children is Defendant Cristina M, McCoy, who is currently residing at
the address indicated in Paragraph 2, above. She is married to Plaintiff.
The father of the children is Plaintiff Neil R. McCoy, who is currently residing at the
address indicated in Paragraph 1, above. He is married to Defendant.
5. The relationship of Plaintiff to the children is that of father.
The Plaintiff currently resides with the following persons:

7. Plaintiff has not participated as a party or witness or in any other capacity, in other
itigation concerning the custody of the parties' children in this or another court.
Plaintiff has no information of a custody proceeding concerning the children pending in a
court of this Commonwealth.
Plaintiff does not know of a person not a party to these proceedings who has
physical custody of the children or claims to have custody or visitation rights with respect to the
children.
8. The best interest and permanent welfare of the children will be served by granting
Plaintiff Nell R. McCoy primary physical custody of the children because Plaintiff is better able
to care for the children and provide a stable nurturing environment.
9. Each parent whose parental rights to the children have not been terminated and the
person who has physical custody of the children have been named as parties to this action. All
other persons, named below, who are known to have or claim a right to custody or visitation of
the children will be given notice of the pendency of this action and the right to intervene: None.
WHEREFORE, PlaintiffNeil R. McCoy requests this Court to grant Plaintiffprimary
physical custody of Alexis M. McCoy and Damon R. McCoy.

ORDER OF COURT
AND NOW, Monday, March 29, 2004 , upon consideration of the attached Complaint,
it is hereby directed that parties and their respective counsel appear betbre Dawn S. Sunday, Esq. ~ the conciliator,
at 39 West Main Street, Mechanicsbur§, PA 17055 on Thursday, April 22, 2004 at 8:30 AM
for a Pre-Hearing Custody Conference. At such conference, an effort will be made to resolve the issues in dispute; or
if this cannot be accomplished, to define and narrow the issues to be heard by the court, and to enter into a temporary
order. All children age five or older may also be present at the conference. Failure to al~pear at the conference may
provide grounds for entry of a temporary or permanent order.
The court hereby directs the parties to furnish any and all existing Protection from Abuse orders,
Special Relief orders, and Custody orders to the conciliator 48 hours prior to scheduled hearing.

ORDER OF COURT

consideration of the attached Custody Conciliation Report, l~ is ordered and directed as follows:
1. The parties shall obtain counseling for the Children with Georgi Anderson, or other
professional selected by agreement. The purpose of the counseling shall be to assess the Children's
needs with regard to the custody arrangements, to determine whether the Children's needs can best be
met by more frequent exchanges of custody for shorter periods of time or less frequent exchanges for
longer periods of time and to obtain professional recommendations and guidance concerning ongoing
custody arrangements which will best serve the needs and interests of the Children. The Mother shall
provide all insurance information regarding coverage for the counseling sessions. Any costs of
counseling which are not covered by insurance shall be shared equally between the parties.
2. The Father, Neil R. McCoy, and the Mother, Cristina M. McCoy, shall have shared legal
custody of Alexis M. McCoy, bom December 14, 1998, and Damon R. McCoy, bom May 19, 2001.
Each parent shall have an equal fight, to be exercised jointly with the other parent, to make all major
non-emergency decisions affecting the Children's general well-being including, but not limited to, all
decisions regarding their health, education and religion. Pursuant to the terms of this paragraph each
parent shall be entitled to all records and information pertaining to the Children including, but not
limited to, school and medical records and information.
3. Pending receipt of written recommendations from the Ch/ldren's counselor and further
agreement of the parties or Order of Court, the Mother shall have custody of the Children every week
from Tuesday after daycare through Friday before daycare and the Father shall have custody for the
remainder of the week and weekend.
4. The Mother shall have custody of the Children on Mother's Day in 2004 from 9:00 am until
7:00 pm and the Father shall have custody on Father's Day. The parties shall share having custody of
the Children on all other holidays as arranged by agreement.
5. Each party shall be entitled to have uninterrupted periods of custody with the Children for
two non-consecutive weeks during the summer upon providing at least thirty days advance notice to

6. Neither party shall do or say anything which may estrange the Children from the other
parent, injure the opinion of the Children as to the other parent, or hamper the free and natural
development of the Children's love and respect for the other parent. Both parties shall ensure that third
parties having contact with the Children comply with this provision.
7. The parties and their counsel shall attend an additional custody conciliation conference in the
office of the conciliator, Dawn Sunday, on July 21, 2004 at 10:30 am for the purpose of reviewing the
custody arrangements with the guidance from the Children's counselor.
8. This Order is entered pursuant to an agreement of the parties at a Custody Conciliation
Conference. The parties may modify the provisions of this Order by mutual consent. In the absence of
mutual consent, the terms of this Order shall control.
