COMPLAINT TO QUIET TITLE
AND NOW, comes the Plaintiff, KDR Investments, LLP, by and through their attorneys,
Blakey, Yost, Bupp & Rausch, LLP, and files this Complaint to Quiet Title, of which the
following is a statement:
1. Plaintiff, KDR Investments, LLP, is a Pennsylvania Limited Partnership with its
principal place of business at 445 South Cameron Street, Harrisburg, Dauphin County,
Pennsylvania 17101.
2. Defendants, William L. Wolf, Sr. and Gertrude A. Wolf, are adult individuals
whose last known address is 6320 Blue Mountain Trail, Enola, Cumberland County,
Pennsylvania 17025.
3. Defendant, PNC Bank, is believed to be a Pennsyvvania Corporation, with offices
at One PNC Plaza, 249 Fifth Avenue, Pittsburgh, Pennsylvania 15222.
4. Plaintiff brings this action pursuant to Pa.R.Civ.P. 1061b, providing in part that an
action to quiet title may be brought to "determine any right, lien, title or interest in the land or
determine the validity or discharge of any documents, obligation or deed affecting any right, lien,
title or interest in land."
5. The premises that are subject to this quiet title action is two tracts known as 6320
Blue Mountain Trail, Enola, Cumberland County, Pennsylvania 17025 (jointly hereinafter "the
Claimed Premises").
6. The Claimed Premises are further described as set forth on Exhibit "A" attached
hereto and incorporated herein.
7. Plaintiff purchased the property for good and fair consideration at the Cumberland
County Pennsylvania Judicial Tax Sale held on November 8, 2007.
8. At the sale of the Claimed Premises, Plaintiff paid $4,813.01 for Tract No. 1, and
$1,264.32 for Tract No. 2.
9. To Plaintiffs knowledge prior to bidding on the property, Defendants were
notified or had knowledge of the tax sale. Pursuant to the Cumberland County Prothonotary
Docket all Defendants were duly served notice of the Tax Sale as set forth on Exhibit "B"
attached hereto and incorporated herein.
10. There is one Open-Mortgage on Tract No. 2, held by PNC Bank.
11. The recorded, unsatisfied Mortgage to PNC Bank, in the original principal
amount of $68,950.75 is dated November 4, 2002, and recorded in the Office of the Recorder of
Deeds of and for Cumberland County, Pennsylvania, at Record Book 1785, Page 1882. A copy
of the Mortgage is hereto attached as Exhibit "C" and incorporated herein.
12. Plaintiff believes and therefore avers that PNC Bank recorded their mortgage on
the incorrect tract, as Tract No. 2 is undeveloped land.
13. As Plaintiff has purchased the property and paid sufficient consideration for the
property, Plaintiff requests that title be quieted in it.
WHEREFORE, Plaintiff requests this Honorable Court grant the following relief:
(a) Defendants, their successors and assigns, having or claiming any right, title, estate, lien or
interest in the Claimed Premises through or under the named Defendant adverse to Plaintiff s
claim of ownership be required to set forth the nature of their claim; and
(b) That all such claims by Defendants, their successors and assigns, having or claiming any
right, title, estate, lien or interest in the Claimed Premises through or under the named
Defendants or in its own right be determined by a decree of this Court; and
(c) Such relief as this Honorable Court may determine necessary and proper to perfect Plaintiff s
title to the Claimed Premises.

Default Judgment against Defendant PNC Bank, and in support thereof avers the following:
1. This is an action to quiet title in which Plaintiff requests that Defendants and any
person claiming under Defendants be permanently enjoined and restrained from asserting any
claim or interest in or to real property described in Plaintiff's Complaint, and more specifically
described in Exhibit A attached hereto.

AMENDED MOTION FOR DEFAULT JUDGMENT
Plaintiff, KDR Investments, LLP, by its undersigned attorneys, files this Motion for
Default Judgment against Defendant PNC Bank, and in support thereof avers the following:
1. This is an action to quiet title in which Plaintiff requests that Defendants and any
person claiming under Defendants be permanently enjoined and restrained from asserting any
claim or interest in or to real property described in Plaintiffs Complaint, and more specifically
described in Exhibit A attached hereto.
2. Attached as Exhibit B is an Affidavit stating that a Complaint containing a notice
to defend was served upon the Defendant PNC Bank by the Allegheny County Sheriffs Office,
and that Defendant PNC Bank has not filed an answer to the Complaint.
3. Pa. R.C.P. No. 1066(a) allows the Court to grant appropriate relief on affidavit
that a Complaint containing notice to defend has been served and Defendants have not filed an
answer.
4. No ruling in this case has ever been made by any judge.
5. A copy of the Motion was served on Defendant PNC Bank on October 16, 2008,
and no objection or opposition has been received.
WHEREFORE, Plaintiff requests this Court to enter an order of default judgment against
Defendant PNC Bank, its successors and assigns, pursuant to Pa. R.C.P. No. 1066(a).
