1. The Plaintiff is Homevest Capital, LLC organized under the laws of the United
States of America with its registered office at 6701 Carmel Road, Suite 110,
Charlotte, NC 28226.
2. Defendant Keith L. Pomraning is an individual residing at 298 Mcallister
Church Road, Carlisle, PA 17013, and is the maker of the note hereinafter
described.
3. Defendant Mountain Lakes Farm Market, Inc. is a Pennsylvania Corporation
with a registered office at 298 Mcallister Church Road, Carlisle, PA 17013.
4. On December 3, 2004, Defendants made, executed and delivered to Bank of
America a note (the "Note"), a true and correct copy of which is attached as
Exhibit "A", to evidence a Business loan ("Loan") made by Plaintiff to
Defendants.
5. As an inducement for Plaintiff to extend credit Defendant Keith Pomaring
executed a Personal Guarantee, a true and correct copy of which is attached
hereto as Exhibit "B".
6. Homevest Capital, LLC. became the owner and holder the aforesaid Loan and
Note through a duly executed Allonge dated May 14`h, 2008 from Bank of
America, a copy of which is attached hereto, made a part hereof and marked
Exhibit "C"
7. The Note was in the original principal amount of $35,000.00, with interest at
the rate of 6% per annum commencing March 29, 2007.
8. The Note is in default because monthly payments of principal and interest are
due and have not been paid since March 28, 2007, whereby the whole
balance of principal and all interest due thereon have become due and
payable forthwith, together with late charges, and costs of collection, and
reasonable attorney's fees,
9. The following amounts are due on said Note and Mortgage:
Balance of Principal $ 32,281.70
Accrued but Unpaid Interest
from 03/29/07 through 06/29/08
at 6% per annum ($5.31 per diem) $ 3,204.15
Reasonable Attorney's Fees $ 1,700.00
TOTAL as of 06/29/2008 $ 37,185.85
10. Pursuant to the Fair Debt Collection Practices Act, 15 U.S.C. § 1692 et seq.
(1977), Defendants may dispute the validity of the debt or any portion thereof.
If Defendants do so in writing within thirty (30) days of receipt of this pleading,
Counsel for Plaintiff will obtain and provide Defendants with written verification
hereof; otherwise, the debt will be assumed to be valid. Likewise, if requested
within thirty (30) days of receipt of this pleading, Counsel for Plaintiff will send
Defendants the name and address of the original creditor if different from
above.
WHEREFORE, Plaintiff demands judgment against Defendants in the amounts due
as set forth in paragraph 9 above, namely $37,185.85 plus the following amounts accruing
after June 29, 2008 to the date of judgment: (a) interest at the rate specified in the Note,
6% per annum or $5.31 per diem; and (b) plus interest at the legal rate allowed on
judgments after the date of judgment, additional attorney's fees (if any) hereafter incurred,
and costs of suit.

That HOME VEST CAPITAL, LLC is the holder of the Promissory Note dated
December 3, 2004 in the amount of $35,000.00 executed by Mountain Lakes Farm and
Keith Pomraning and payable to Bank of America, N.A.
2. That the original of the Promissory Note and all endorsements thereon, is lost and/or missing;
and that after diligent search HOME VEST CAPITAL, LLC cannot locate the original of
said Note and endorsements.
3. That the Promissory Note has not been negotiated, modified, amended, altered or assigned to
any other person or party or released, as of the date of this affidavit.
