PETITION FOR APPOINTMENT OF GUARDIAN NOW comes petitioner, JUDITH R. VETOCK, by her attorney, Harold S. Irwin, III, Esquire, and... presents this petition for appointment of guardian over CHARLOTTE K. ROBSON, ark alleged - -- incapacitated person, representing as follows: 1. Petitioner is JUDITH R. VETOCK, an adult individual and daughter of the alleged incapacitated person, residing at 264 South West Street, Carlisle, Cumberland County, Pennsylvania 17013. 2. The alleged incompetent is CHARLOTTE K. ROBSON, born January 10, 1918 (age 90 years), whose permanent residence address is Claremont Nursing and Rehabilitation Center, 1000 Claremont Road, Carlisle, Cumberland County, Pennsylvania 17013. 3. The alleged incapacitated person became incapacitated and has been unable to handle her own affairs for about the last six months to a year. 4. The following persons are the alleged incapacitated person's next-of-kin: Judith R. Vetock (daughter and petitioner), John D. Robson (son), who resides at 1308 Maplehurst Drive, Somerset, Pennsylvania 15501 and Scott J. Robson (son), who resides at 29 Wyoming Street, Johnstown, Pennsylvania 15905. 5. Petitioner has no knowledge of any other Court within this Commonwealth, which has appointed a guardian for the alleged incapacitated person. 6. Prior to the onset of the alleged incapacity and at present, the alleged incapacitated person's sole income is social security and her assets are extremely limited. 7. The alleged incapacitated person is incapable of handling her financial affairs for the reasons set forth in a competency affidavit, prepared by her treating physician, which statement is incorporated herein by reference and attached hereto as Exhibit "A". 8. Petitioner, having no interest adverse to the alleged incapacitated person, has agreed to act as guardian if this Honorable Court shall so appoint. The consent of the proposed guardian is incorporated herein by reference and attached hereto as Exhibit "B". 9. The remaining next-of-kin have also consented to the guardianship and their consents are attached hereto as Exhibits "C" and "D". WHEREFORE, petitioner respectfully requests this Honorable Court issue a rule upon Charlotte K. Robson, the alleged incapacitated person, with notice thereof to be given to her next-of-kin, and to such other persons as this Court may direct, to show cause why she should not be adjudged an incapacitated person and petitioner be appointed guardian of her person and estate. I have examined the alleged incapacitated person, Charlotte K. Robson, with care and diligence. Based upon said examination and observation, I am of the opinion that she is incompetent to manage her own affairs and that there is no expectation of her recovery within a reasonable medical certainty. In addition, it is my opinion that no useful purpose would be served by Ms. Robson's appearance at a hearing to adjudicate her competency and, in fact, attendance at such a hearing could well be adverse to her well-being.
