AND NOW on this ~ day of August, 2008, after a conference via telephone with
legal counsel involved in this case and in light of the various of motions that are pending before
this Court, it is Ordered and directed as follows:

The hearings previously scheduled for September 8, 2008 through September 10, 2008,
are hereby canceled.

The parties and legal counsel shall submit to mediation with a mediator agreed upon by
legal counsel for the parties. The mediation shall be conducted on Monday, September 8, 2008.

mediation and what further actions are necessary in this case. Attorney Gilroy shall
initiate the telephone conference.

Pending resolution of the mediation and the telephonic pre-trial conference
scheduled above, all matters in this case stayed. The appropriate opportunity will be
given to all parties to file any appropriate answers to pending motions or other
appropriate pleadings as necessary.
