Plaintiff is TRISHA BEERS who currently resides at 19 Gettysburg Pike, Apt #10, Mechanicsburg, Cumberland County, PA 17055. 2. Defendant is WILLIAM E. BEERS, III, who currently resides at 83 (Rear) Autumn Lane, Enola, PA 17025. 3. Plaintiff seeks joint legal and primary physical custody of the parties' children, THEODORE BEERS, born 6/21/02 (age 6); TYLER BEERS, born 10/2/03 (age 4); and JAYDON BEERS, born 11/29/05 (age 2). 4. She is married to Defendant. 7. The relationship of the Defendant to the children is that of the natural father. He is married to Plaintiff. 8. Defendant left the marital place of residence on August 15, 2008 and currently lives with a girlfriend, Alyssa, whom he met approximately two weeks prior to moving in with her. 9. Plaintiff has not participated as a party or witness, or in any other capacity in other litigation, concerning the custody of the children in this or another court. Plaintiff has no information of a custody proceeding concerning the children pending in any Court of this Commonwealth. Plaintiff does not know of a person not a party to the proceedings who has physical custody of the children or claims to have custody or visitation rights with respect to the children. 10. The best interest and permanent welfare of the children will be served by granting Plaintiff primary physical custody (with Mother and Father sharing legal custody) as Mother has been the primary caretaker and Father has just moved in with a woman he has known for less than one week. A , . 6 11. Each parent whose parental rights to the children has not been terminated and the persons who have physical custody of the children have been named as parties to this action. BEERS, III IN CUSTODY DEFENDANT ORDER OF COURT AND NOW, Thursday, September 04, 2008 , upon consideration of the attached Complaint, it is hereby directed that parties and their respective counsel appear before Hubert X. Gilroy, Esq. , the conciliator, at 4th Floor, Cumberland County Courthouse, Carlisle on Friday, September 26, 2008 at 10:30 AM for a Pre-Hearing Custody Conference. At such conference, an effort will be made to resolve the issues in dispute; or if this cannot be accomplished, to define and narrow the issues to be heard by the court, and to enter into a temporary order. All children age five or older may also be present at the conference. Failure to appear at the conference may provide grounds for entry of a temporary or permanent order.
