IN THE COURT OF COMMON PLEAS OF
CUMBERLAND COUNTY, PENNSYLVANIA
PETITION FOR APPROVAL TO ENGAGE SPECIAL COUNSEL
AND NOW, comes the Board of Commissioners of the County of Cumberland, by and
through the County Solicitor, Edward L. Schorpp, Esquire, and requests approval for engagement
of special counsel upon the following:
1. The Board of Commissioners of the County of Cumberland requires the services of
special counsel in litigation matters from time to time.
2. The hours of work of the duly appointed County Solicitor and Assistant County
Solicitors, under the salary structure established for their positions, does not permit suitable
compensation in excess of their respective salaries for time expended in extended litigation matters.
3. The Board of Commissioners has determined not to adjust solicitors' salaries to
compensate for time expended in protracted litigation, but desires to retain special counsel in such
instances.
3. The Board of Commissioners has agreed to retain the services of
Keith O. Brenneman, Esquire, Snelbaker, Breuneman & Spare, 44 West Main Street,
Mechanicsburg, PA 17055, to render legal services and represent the County's interest at the hourly
rate of $125.00 in litigation docketed at 00-0400 in the matter of County of Cumberland v. Sowers,
Garner, Savlor Architects and Engineers, Inc. v. The Norwood Company.
4. Section 904 of the County Code, 16 P.S. § 904, requires the approval of the Court of
Common Pleas for the appointment of special counsel.
WHEREFORE, the Board of Commissioners of Cumberland County respectfully requests
Your Honorable Court to approve the appointment of Keith O. Brenneman, Esquire, as special
counsel to represent the County's interest in the above litigation, to serve at the pleasure of the Board
of Commissioners.
